foreign nationals, and PIOs i.e. persons of
Indian origin have to make sure that the land on
the purchased property which is not an
agricultural land or a plantation property as
these types of land can be purchased only by an
agriculturist who is a citizen of India. A
residing citizen of India outside India or PIO
doesnt need any special permission to buy any
immovable property in India. The payment,
however, has made in the Indian currency through
the normal banking channels or the funds
maintained in the non-resident accounts under the
FEMA and Reserve Bank of India regulations.
Foreign companies and foreign nationals are
barred from the purchasing a property in
India. Any commercial or residential property can
be bought by Non-resident India but no business
can be carried out on premises. As far as the
disposal of any property is concerned, a
non-resident Indians can actually sell his
property to fellow non-resident India or any
Indian citizens. NRIs and foreign national
investing in the real estate business With the
ban on direct business, non-resident is allowed
to invest in the real estate development activity
through the Indian organizations. As per the new
policy, any project under-construction,
irrespective of the size, it can have access to
FDI. There is a lock-in the period of 3 years
before the minimum investment which can be
repatriated. The investments may be routed with
Singapore or Mauritius so as to make the use of
the tax treaty provisions. With the exchange
control regime as well as tax laws, it is very
important to note that the succession laws in
India are regions as well as community-specific.
For example, Muslims and Hindus are governed by
varied succession rules which have to be read
with the FEMA regulations. Planning and

situation.
