2A BRIEF INTRODUCTION TO DUI IN CANADA
3INTRODUCTION
In Canada, the term impaired driving is used to
refer to the criminal offence of operating,
having care or the control of a motor vehicle
while the person's ability to operate the vehicle
is impaired by a drug or alcohol. Driving under
the influence of alcohol or a drug is punishable
under multiple offences in the Criminal Code. The
penalties depend on the consequences caused by
the impaired driving.
4Drug Evaluation
If a police officer has reasonable grounds that a
person is driving under the influence of alcohol
or drugs, they can request the driver to submit
to an evaluation to determine whether or not the
driver is driving impaired. The Breathalyzer is
a common technique to collect a sample of breath
which helps identify if the driver is drunk.
