Graduated from the University Of Pittsburgh
School Of Law, Mr. Morgenstern has 35 years of
experience of litigating with his practice
ranging focusing on premises liability lawyer
and wrongful death claims to include automobile
and motorcycle accident, product liability,
medical malpractice, premises liability, and
general negligence claims, etc. He has also
represented railroad employees in claims under
the Federal Employers Liability Act (FELA), as
well as seamen and longshoremen in claims under
the Jones Act and Section 905(b) of the
Longshore and Harbor Workers Compensation Act
(LHWCA), for injuries incurred in the course of
their employment He was the Sole Name Partner of
the Law firm which underwent a name change due to
the merger and was later named Morgenstern
Herd in 2007.

HOW DO MEDIATION AND ARBITRATION WORK IN A
PERSONAL INJURY CASE?
A trial is a formal legal proceeding which takes
place inside a courtroom, where there are strict
rules for what can be presented as evidence.
Decisions made during a trial are based on the
applicable law and the evidence presented. The
decisions/award rendered at trial can generally
be appealed. Mediations and arbitrations are much
more flexible. Mediation is an informal process.
The legal counsel for both parties agree on a
mediator to use who will meet with both parties
and assist them in trying to reach a settlement
agreement.
