Introduction Labour Law in Nepal
  • The Labour Act 2074 has changed the employment
    laws in Nepal significantly.
  • According to the preamble of the Act, labour laws
    in Nepal are enacted for the benefit of workers
    and the protection of their rights, interests,
    and benefits, as well as clear provisions on
    employers' rights and responsibilities.
  • The legislation was passed by Parliament on 11
    August 2017 (27 Shrawan,2074) for the promotion
    of good industrial relations and the abolition of
    all forms of labour exploitation.
  • A company, private firm, partnership firm,
    cooperative association or corporation, or any
    other organization founded or incorporated, or
    organized according to the prevailing laws and
    operated with the purpose of engaging in any
    industry, occupation, or service, with or without
    the goal of earning a profit, is a company or
    firm under section 2 (j) of the Labour Act, 2074.

Types of Employee

Types of Employee
  • According to Labour law in Nepal based on the
    task, time , part time , full time
  • Regular Employment Any employment other than
    those Task based employment, Time based
    employment, and Casual employment.
  • Task based Employment Employment given a
    particular task or service that is specified by
    the employer which is needed to be achieved.
  • Time based Employment Any work given to
    Employment should achieved service or task within
    a period fixed by the employer.
  • Casual Employment Any employment given a certain
    task or service where worker is engaged for seven
    or less than seven days within a period of one
    month.
  • Part Time Employment Worker is engaged by the
    employer for thirty-five hours or lesser than
    thirty -ive hours in a week to accomplish any
    work.

Provisions Relating to Working Hours /over time
  • Labour law in Nepal declares that more than 8
    hours a day and 48 hours a week will not be
    allowed to a workers to work.
  • There will be provision of half an hour rest
    after five hours of frequent.
  • A worker may be required to work a maximum of
    four hours a day and 24 hours a week if his or
    her employer requires more work than is
    prescribed under section 28.
  • According to section 42 ,any worker without any
    arrangement for situate leave shall not be deemed
    to be overtime work.
