3TN VISA ASSISTANCE FOR YOUR IMMIGRATION NEEDS!
TN visas are nonimmigrant work visas that
originally granted Mexican and Canadian citizens
the right to work in the U.S. under the
provisions of the North American Free Trade
Agreement (NAFTA). In 2020, NAFTA was replaced by
a new agreement between the U.S.
4WHO IS ELIGIBLE TO APPLY FOR A TN VISA?
U.S. immigration law dictates that Canadian or
Mexican citizens may seek admission to the U.S.
through TN visas if they meet applicable license
requirements, which include
- To fulfill a NAFTA-approved employment position.
- Have a legitimate job offer from a United States
employer that requires the assistance of a NAFTA
professional. - Will be employed in either a prearranged
full-time or part-time job. - Possesses the professional qualifications or
skills needed for the employment position.
5It should also be stated that TN visa applicants
must provide the required documentation to obtain
a TN visa. Examples include a such as
- Proof of Mexican or Canadian citizenship, such as
a passport. - Job offer letter.
- Educational qualifications, including a
bachelors or masters degree. - Proof of previous employment
6CAN INDIVIDUALS OBTAIN A GREEN CARD THROUGH A TN
VISA?
If a Customs and Border Protection officer
determines that TN visa applicants are eligible
for admission into the United States, they are
granted entry as a TN nonimmigrant. TN visas are
considered single intent visas, meaning that
holders must declare their intention of leaving
the country when their visa expires. The initial
period of stay is up to three years, which may be
extended if a United States employer files a
Petition for Nonimmigrant Worker on the
employees behalf. However, many TN visa holders
wish to obtain a green card that will allow them
to establish permanent residency and live and
work in the United States.
7WHAT IS THE DIFFERENCE BETWEEN A TN-1 AND TN-2
VISA?
Even though TN visas are granted to NAFTA
professionals who meet applicable license
requirements, there are different identifiers for
Canadian and Mexican citizens. A TN-1 visa is
assigned to Canadian citizens who meet
eligibility requirements. Canadian citizens can
request TN status at a port of entry. Mexican
citizens approved to work in a NAFTA professional
capacity are issued TN-2 visas. For both Tn-1
and TN-2 visas, individuals cleared to enter the
U.S. are issued a Form I-94 Arrival-Departure
Record that indicates their TN nonimmigrant
status and the maximum period they are authorized
to stay in the country.
