Duties of Governing bodies in relation to the
welfare of children
  • The Governing Body of a maintained school shall
    make arrangements for ensuring that their
    functions relating to the conduct of the school
    are exercised with a view to safeguarding and
    promoting the welfare of children who are pupils
    at their school.

Significant Harm
  • This concept was introduced by the Children Act
    1989 as the threshold for intervention in family
    life for the protection of children.

    emotional, social or behavioural development
  • health physical or mental health
  • Ill treatment includes sexual abuse and forms
    of ill treatment which are not physical

Threshold for Significant HarmThere is no
absolute criteria on which to rely
  • Significant harm can be caused by one traumatic
    event or a compilation of events that interrupt,
    change or damage the childs physical or
    psychological development.

  • It is necessary to consider
  • The severity of ill treatment, the degree and
    extent of physical harm, the duration and
    frequency of abuse and neglect, the extent of
    pre-meditation and the degree of threat and
    coercion, sadism and bizarre or unusual elements
    in child sexual abuse.

Physical Abuse
  • May involve
  • Hitting, shaking, throwing, poisoning, burning
  • or scalding, drowning, suffocating
  • Otherwise causing physical harm to a child.
  • Factitious illness by proxy

Sexual Abuse
  • Forcing or enticing a child or young person to
    take part in sexual activities, whether or not
    the child is aware.
  • Physical contact, including penetrative or
    non-penetrative acts.
  • Non-physical contact e.g. looking at or
    involvement in making pornographic material,
    watching sexual activity, encouraging to behave
    in sexually inappropriate ways.

Emotional Abuse
  • The Persistent emotional ill-treatment of a
    child such as to cause severe and persistent
    adverse effects on childs emotional
    development.
  • Involved in all types of ill-treatment, but may
    occur alone.

Emotional Abuse
  • May involve
  • conveying to children they are worthless or
    unloved, inadequate, or not valued.
  • Age or developmentally inappropriate
    expectations.
  • Causing children frequently to feel frightened or
    in danger.
  • Exploitation or corruption.

Neglect
  • Persistent failure to meet a childs basic
    physical and/or psychological needs, likely to
    result in the serious impairment of the childs
    health or development.

NeglectMay involve
  • Failing to provide adequate food, shelter and
    clothing
  • Failing to protect a child from physical harm or
    danger
  • Failing to ensure access to appropriate medical
    care or treatment
  • Neglect of, or unresponsiveness to, a childs
    basic emotional needs

Child in NeedThis concept was introduced by
the Children Act 1989. Each Authority should
safeguard and promote the welfare of children in
their area who are
  • Unlikely to reach or maintain a satisfactory
    level of health or development, or
  • Health development will be significantly
    impaired without the provision of services
