• Accountability means being held responsible.
• Provides a foundation for transparency, equity,
  efficiency and rule of law
• Plays critical role for effective functioning of
  democracies
• Legal framework of Local Government System
  provides effective mechanism of checks balance.

MISCONDUCT
Misconduct means transgression of prescribed
Code of Conduct or dereliction from duty or
deliberate unlawful behavior or violation of law
or rules or lawful directions or orders of
Government and includes-

• gross negligence in performance of duties with
  manifest wrongful intent or evil design
• an act that results in wrongful gain to any
  person by wrongful application of law or
• making or managing appointment, promotion or
  transfer of an officer or official in violation
  of law or rules or for extraneous consideration

PROVINCIAL LOCAL GOVERNMENT COMMISSION

• Composition
• Chairman- Minister for Local Government
• Members-
• Two from general public, one each nominated by
  leader of the House and leader of the Opposition
  of the Provincial Assembly
• Two eminently qualified and experienced
  technocrat
• Secretary, Local Government and Rural Development
  Department

PLGC
Functions/Authority

• annual and special inspections of all local
  governments
• inquiry into any matter concerning a local
  government
• special audit of any local government
• Dispute resolution between Provincial Government
  Department and District Government and between
  two district governments.
• Take cognizance of violations of laws and rules
  by local governments.
• To act as consultative forum for the
  parliamentarians and Zila and Tehsil/town Nazims
  of the District for development activities.
• Recommend appropriate action including removal of
  a Nazim/Naib Nazim/Councillor found guilty of
  misconduct to the Chief Minister
• Direction issued by LGC is binding on local
  governments
• LGC enjoys powers of Civil Court for its
  inspections, inquiries, special audit.

MAL-ADMINISTRATION

• mal-administration means and includes
• an act of omission or commission, a decision,
  process or recommendation, which
• is contrary to the law, rules or regulations or
  is a departure from established practice or
  procedure or
• is arbitrary, biased, discriminatory, oppressive,
  perverse, unjust or unreasonable or
• is based on irrelevant grounds or
• involves the exercise of powers or the failure or
  refusal to do so, for corrupt or improper
  motives, such as administrative excess, bribery,
  favoritism, jobbery and nepotism or
• delay, inaction, incompetence, inefficiency,
  ineptitude or neglect in the administration or
  discharge of duties and responsibilities or
• avoidance of disciplinary action against an
  officer or official whose action is held by a
  competent authority to be biased, capricious,
  patently illegal or vindictive
