The Hazardous Waste Regulations
  • Introduced 16 July 2005
  • Replace the Special Waste Regulations in England
    and Wales
  • Regulations in Scotland and N. Ireland are
    different
  • They do not apply to householders

The Hazardous Waste Regulations
  • Anyone who produces hazardous waste must register
    (annually) as a producer of hazardous waste with
    the Environment Agency
  • Registration can be done in a number of ways, the
    least costly being internet registration (18 per
    year 2005 prices)

  • Telephone
  • Internet for single notification
  • E-mail for bulk notification
  • Disc for bulk notification

Notification
  • Each site must register and not just a single
    registration via Head Office
  • A waste contractor who collects waste from
    someone who is not registered is also committing
    an offence under the regulations

Notification
  • A Consignee can notify on the producers behalf
  • Notification number will be issued on payment of
    the fee
  • In the case of contractors, either the contractor
    or the site can notify

The Hazardous Waste Regulations
  • Certain premises e.g. offices, nursing homes,
    dental surgeries and others (specified in the
    regulations) do not need to register IF they
    produced less than 200kg hazardous waste per
    year.
  • Though some (above) do not need to register with
    the Agency ALL other requirements apply

  • Some wastes that were not always Special wastes
    are now hazardous wastes.
  • This includes fluorescent tubes (lighting) waste
    oil (except vegetable oil) un-depolluted scrap
    cars waste electrical and electronic equipment
    containing cathode ray tubes (screens) and other
    hazardous elements

  • Agencies have published comprehensive guidance on
    Hazardous Waste
  • WM2 Hazardous Waste - Interpretation of the
    definition and classification of hazardous waste
  • Identifies absolute hazardous waste entries from
    mirror entries by use of a colour-coded list
  • Provides detailed analysis of the hazardous
    properties and sources of data

  • 20 Chapters, split into Sub Chapters and then
    individual 6 digit Waste Codes
  • First 12 Chapters - industrial process specific
  • Chapters 13 to 15 material specific - Oils,
    Solvents, Packaging
  • Chapter 16 - A mixed bag of wastes not specified
    elsewhere
  • Chapters 17 - 19 - Activity Specific
  • Construction Waste, Healthcare Waste and Wastes
    resulting from Waste Management Water treatment
    Activities
  • Chapter 20 - Municipal Waste, including similar
    Industrial and Commercial wastes

EWC - Types of waste entries
  • Absolute entries
  • Wastes marked as absolute entries are always
    hazardous regardless of composition
  • Need to determine the appropriate hazards for
    Duty of Care
  • Non Hazardous entries
  • A waste which is not marked with an asterisk, and
    which does not form part of a mirror entry is not
    hazardous regardless of composition

  • Producers of hazardous are not allowed to mix
    hazardous waste with other categories of
    hazardous waste or with non hazardous waste,
    except in accordance with a relevant permit
  • Therefore producers must have separate collection
    and storage facilities for hazardous wastes (e.g.
    fluorescent tubes)

  • As a result of these regulations and changes
    brought about through the landfill regulations,
    hazardous waste disposal costs have increased
  • Those hazardous waste disposed to landfill for
    30 - 50 per tonne in 2004 now cost approx 150
    - 200 per tonne
