  • ? In May 2000, the ACLU and other public interest
    advocates representing students across the state,
    filed a lawsuit against the State of California,
    the Superintendent of Public Instruction, State
    Board of Education and the California Department
    of Education.

    implemented by

  • SB 550 COMPLIANCE AND ACCOUNTABILITY
  • Uniform Complaint Procedure Must now cover
    complaints related to insufficient textbooks,
    teacher vacancy or misassignments and emergency
    or urgent facilities conditions, particularly
    those that threaten health or safety.

  • SB 550 - INSTRUCTIONAL MATERIALS
  • (1) The Board of Education is now required to
    hold a public hearing at or before the 8th week
    of the school year to determine whether each
    student in the district has sufficient textbooks.
    If sufficient supplies do not exist, the Board
    must set forth the reasons why and take steps to
    address the problem.

  • SB 550 INSTRUCTIONAL MATERIALS
  • (2) Sufficiency of instructional materials
    defined as each pupil, including English
    learners, has a textbook or instructional
    materials, or both, to use in class and to take
    home to complete required homework assignments.
    However, does not require two sets of textbooks
    or instructional materials for each pupil.
  • (3) K-8 textbooks must be from latest
    state-approved list. 9-12 textbooks must be
    certified by local boards to be standards
    aligned.

  • (4) If the District determines insufficiency the
    Boards textbook resolution must define (a)
    subjects in which instructional materials are
    sufficient/insufficient (b) the reason for the

    texts or materials.
  • (5) The Board must provide textbook
    insufficiency information to teachers and to the
    public.
  • (6) The District must remedy the insufficiency
    by the 8th
  • week of the school year (2005) and on
    or within 2
  • months of the time the determination of
    insufficiency
  • was made.

    instead of textbooks.

    standards-based series in both language and
    math.
  • - Textbooks must now be purchased to be Williams
    compliant.

  • In summer of 2002 middle school social science
    teachers reviewed books on the state approved
    list and determined that
  • a. No book on the 1999 state approved list was a
  • significant improvement over books
    currently in use.
  • b. The quality of books available did not
    justify the expense.
  • c. The District should wait until the next state
    adoption cycle.
  • The CDE postponed the state adoption process for
    social studies for 2 years (now scheduled for
    2005).
  • Textbooks must be purchased to become Williams
    compliant when the new state approved textbook
    list is available in November 2005.

  • - Grade 11 Holt series class sets purchased for
    literature and grammar.
  • - The adoption committee intended that the
    Interactive Reader would be available to use at
    home for homework.
  • - District has now purchased the literature
    textbook for every student.
  • - Grade 12 materials consist of novels and
    grammar instruction keyed to content standards.
  • - District has now purchased textbooks for every
    student in addition to the novel and grammar
    textbooks.

  • 1. Conduct public hearing and pass Board
    resolution stating insufficiency, as defined by
    Williams legislation.

  • 3. Prepare schools and compliance documents for
    LACOE. visit.
  • 4. Submit intent to purchase and reimbursement
    claim for ELD materials for focus schools by
    March 15, 2005.
  • 5. Provide training for principals.

  • Notices posted in each classroom stating
    facilities must be clean, safe and in good repair
    and the procedures for filing a complaint .
  • OPSC has prepared an interim facilities
    evaluation instrument.
  • Department of Facilities is using the interim
    evaluation instrument as an outline for
    establishing LACOEs inspection format.
  • State Allocation Board adopted regulations at
    their January 26, 2005, meeting for grants to
    schools in deciles 1 to 3 for required facility
    assessment.
  • - District will now begin the process for
    selection of consultant to do facilities
    assessments.

  • Department of Facilities staff have begun
    identifying possible potential required repairs.
  • Once identified and verified by the LACOE pilot
    inspection, District will begin making repairs on
    emergency items and submit required reimbursement
    claim to OPSC.
  • - Historical facilities data regarding repairs,
    construction plans, etc. for schools in deciles 1
    to 3 has been assembled and submitted to LACOE in
    preparation for their pilot inspection process.
