Central Contractor Registration
  • The Creation/Integration of CCR
  • CCR was created to be the single repository of
    vendor data for the entire Federal government to
    avoid administrative duplication and allow
    contractors to take responsibility for the
    accuracy of their own important business
    information by supplying it directly to the
    government through a single registration. The
    integration of PRO-Net and DOD's Central
    Contractor Registration (CCR) databases has
    created one portal for entering and searching
    small business sources. This integration assists
    small businesses with marketing their goods and
    services to the federal government. The
    CCR/Pro-Net linkage was part of a comprehensive
    strategic effort to transfer government-wide
    vendor registration. The network is part of the
    Integrated Acquisition Environment (IAE), one of
    the e-government initiatives under the
    President's Management Agenda. IAE is carrying
    out OMB's mandate for new processes to streamline
    federal acquisition by creating common integrated
    business processes for buyers and sellers in the
    federal marketplace.
  • The Mandate
  • Effective January 1, 2004, all contractors
    interested in doing business with the Federal
    Government MUST BE registered in CCR.
  • Who Registers
  • Prospective vendors must be registered in CCR
    prior to the award of a contract basic
    agreement, basic ordering agreement, or blanket
    purchase agreement
  • Prime contractors are not required to have their
    subcontractors register in CCR. If a prime's
    subcontractor wants to bid directly for
    contracts, they should register in the CCR.
  • A Government Agency is required to register if
    the awarded contract is governed by the FAR
    www.ccr.gov

Mentor-Protégé Program
  • Applies to solicitations more than 500,000.
  • Prime contractors accepted as mentors provide
    technical and managerial support to protégé
    subcontractors.
  • Unlike the DOD program, our program offers no
    financial incentives. Instead, mentors are
    awarded points within technical evaluation
    criteria of the RFP.

Small BusinessVendor Profile Database
The system has been developed to track small,
small disadvantaged, minority, women-owned,
service disabled veterans, american
indians/alaska natives businesses, HBCUs, HACUs
and MIs available to do business with EPA. This
database provides a means to search and retrieve
vendors by ownership, NAICS, Corporate
Capabilities, SBA 8(a) status, and other
designations as desired, to meet the needs of
OSDBU. The public has access through the WEB.

On-Going InitiativeContract Bundling
  • Contract Bundling occurs when separate smaller
    contracts are combined in such a manner that it
    makes difficult for small businesses to compete.
  • Final rule on contract bundling dated October 20,
    2003. Requires Federal Agencies to review
    requirements for potential bundling.
  • When unjustified bundling is identified, Agencies
    must either break the contracts into smaller
    pieces or mitigate the impact on small businesses
    by increasing subcontracting opportunities or
    through some other action.

EPAs Indirect Procurement Program
  • EPA is one of three Federal Agencies (the other
    two are DOT and NASA) that has a goaling program
    for procurement dollars going to MBEs and WBEs
    through assistance agreements.
  • This is a key program for the small business
    community because EPA spends about 4 times as
    much under grant programs as we spend under
    direct procurement programs.
  • EPA has two National Goals which are based on
    statutes
  • Public Law 101-549, November 15, 1990
  • To the extent practicable, not less than 10 of
    the funding for research resulting from the Clean
    Air Act Amendments of 1990 will be made available
    to DBEs.
  • Public Law 102-389, October 6, 1992.
  • To the fullest extent possible, at least 8 of
    federal funding for prime and subcontracts
    awarded in support of authorized programs will
    be made available to socially and economically
    disadvantaged individuals (within the meaning of
    Section 8(a)(5) and (6) of the Small Business
    Act) to include HBCUs and Women.

  • Prior to Adarand Constructors, Inc. V. Pena, 115
    S. Ct. 2097 (1995)
  • 8 or 10 goal, as appropriate was put into all
    grants.
  • Post Adarand
  • Goals in each grant are based on the
    availability of MBEs and WBEs in the requisite
    geographical area.
  • Grant recipients and sub recipients must make
    efforts to identify MBE and WBE firms and report
    actual accomplishments to EPA on EPA Form
    5700-52A.
  • Goals are not included in images and cooperative
    agreements. The recipient just reports actual
    accomplishments.
  • All accomplishments, to include direct
    procurement accomplishments are reported to
    Congress annually.

Proposed RuleDisadvantaged Business Entereprise
(DBE)
  • EPA Is in the process of finalizing a Proposed
    DBE Rule which will implement the following
    changes
  • Name Change The program will be called EPAs
    DBE program.
  • EPA will no longer accept self certification.
  • EPA would require that an entity first to become
    certified as an MBE or WBE by the SBA or DOT
    under their respective programs or by an Indian
    Tribal Government, State Government, local
    Government or independent private organization.
  • Individuals claiming disadvantaged status must
    have an initial and continued personal net worth
    of less than 750,000.

Proposed DBE Rule (cont.)
  • Fair Share Negotiationshow recipients will
    determine their goals. Indian Tribes and Trust
    Territories will have to negotiate goals. The
    DRAFT Rule exempts recipients receiving 250,000
    or less from fair share negotiations.
  • CertificationDBEs must now be certified.
  • Steps to take to identify and solicit DBEs.

DBE Rule (contd)
  • The rule improves the management of the program
    and responds the US Supreme Courts ruling in
    Adarand v. Pena. OSDBU management held hearings
    across the country on these proposed rules.
  • EPA is currently evaluating comments received on
    the proposed DBE Rule.
  • The Final DBE Rule is expected within 18 months.
