Block Grant Requirements(45 CFR Part 96)
  • In expending the grant, the State will expend
  • Grant funds only for the purpose of planning,
    carrying out, and evaluating activities to
    prevent and treat substance abuse and for related
    activities as authorized in the block grant.
  • Not less than 20 percent for prevention programs.
  • An amount, not to exceed 5 percent of the grant,
    on activities for HIV early intervention
    services.
  • No more than 5 percent of the grant for
    administration.

Restrictions on Expenditures
  • The State shall not expend the Block Grant to
  • Provide inpatient hospital services.
  • Make cash payments to intended recipients of
    health services.
  • Purchase or improve land, to purchase, construct
    or remodel any building, or purchase major
    medical equipment.
  • Provide financial assistance to any entity other
    than a public or nonprofit private entity.
  • Provide individuals with hypodermic needles or
    syringes.

Womens Services
  • The State shall expend an amount as prescribed
    by Section 96.124(c) on treatment services
    designed for pregnant women and women with
    dependent children. Women who are attempting to
    regain custody of their children are included.
    Treatment programs receiving such funding will
    treat the family as a unit and, at a minimum,
    must provide or arrange for the following
    services
  • Primary medical care for women, including
    prenatal care.
  • Primary pediatric care for their children.
  • Gender specific substance abuse treatment and
    other therapeutic services which may address
    issues of relationships, parenting, sexual and
    physical abuse.
  • Therapeutic interventions for their children
    which address their developmental needs and
    issues of sexual and physical abuse and neglect.
  • Case management, transportation and child care to
    ensure access to treatment.
  • Outreach to inform pregnant women of the services
    and priorities.

Priority for Admission
  • Programs serving pregnant women and injecting
    drug users shall give preference for treatment
    admission, as follows
  • Pregnant injecting drug users must be admitted
    within 48 hours or, if no service is available,
    must be provided with interim services to include
    a referral for prenatal care.
  • Pregnant substance abusers must also be admitted
    within 48 hours or be referred for interim
    services.
  • Injecting drug users must be admitted within 14
    days or, if no services are available, must be
    provided with interim services.
  • All others.

Prevention Priorities
  • When carrying out prevention programs
  • priority will be given to those populations that
    are at risk of developing a pattern of substance
    abuse and
  • community-based strategies shall be developed for
    prevention of substance abuse, including
    strategies to discourage the use of alcoholic
    beverages and tobacco products to individuals to
    whom such sale would be illegal.

FFY 2006 SAPTBG Application
  • The State anticipates an FFY 2006 award of
    95,290,319.
  • This award covers the federal funding period
    October 1, 2005 through September 30, 2006.
  • All funds must be expended within 24 months of
    the award.

FFY 2006 SAPTBG Application
  • Five SAPT Block Grant requirements have direct
    fiscal implication on how SAPT Block Grant and
    State funds are expended, and are as follows
  • The State must expend not less than 20 percent of
    the award on primary prevention programs for
    individuals who do not require treatment for
    substance abuse.
  • The State must expend an amount on services and
    activities designed specifically for women with
    dependent children and pregnant women that is not
    less than the amount expended in FY 1994.
  • The State must expend at least five percent of
    the SAPT award on HIV Early Intervention services
    for individuals who are being treated for
    substance abuse problems at the site where the
    treatment is being provided.

  • The State cannot expend more than five percent of
    the SAPT award on administration of the grant.
  • The SAPT Block Grant requires that the
    expenditure of State funds in any state fiscal
    year be not less than the average of State
    expenditures in the prior two fiscal years
    (Maintenance of Effort).

FFY 2006 SAPTBG Application
  • The FFY 2005 SAPTBG application included an
    Maintenance of Effort (MOE) shortfall of
    4,883,137.
  • A subsequent calculation reduced the shortfall to
    2,434,997.
  • Florida has requested a determination from the
    federal government that the state was in material
    compliance with this requirement to prevent a
    reduction in the block grant award.

  • Additional provisions to meet other SAPT
    requirements include
  • preference for admission to treatment for
    intravenous drug users and for pregnant women
  • outreach to intravenous drug users and
  • compliance with federal provisions prohibiting
    the sale of tobacco products to minors.
