WHAT IT GOVERNS
  • The disposal of waste from ships at the

AIM
  • To protect the marine environment by reducing
    discharges into the sea of ship generated waste
    and cargo residues to improve the availability
    and use of reception facilities and strengthen
    the enforcement régime

EUROPE -v- UK
  • EU Directive came into force December 2000
  • Member States implement by December 2002
  • There will be some changes to current UK system
  • No draft UK legislation yet

UK BROADLY IN LINE WITH EU
  • UK has taken subject seriously since 1995
  • Introduced voluntary system
  • Followed by statutory intervention
  • Changes to comply with Directive relate to
    charging
  • Basic process remains constant

    ports of the Member State normally visited by
    such vessels

  • Aim to ensure that the needs of potential users

ANALYSING THE NEED FOR WASTE RECEPTION FACILITIES
  • Aim to assemble information to allow the port
    to assess what facilities should be provided

CONSIDERING THE TYPE AND CAPACITY OF WASTE
RECEPTION FACILITIES
  • Aim to provide facilities which are suitable
    for the types and amounts of waste which should
    be received in the port

CONSIDERING LOCATION AND EASE OF USE
  • Aim to provide facilities which, so far as
    reasonably practicable, avoid disincentives
    towards their use

COST OF FACILITIES
  • Aim to ensure that the cost of waste reception
    facilities does not encourage illegal disposal of
    waste

PROVIDING INFORMATION TO USERS
  • Aim to ensure that all mariners are aware of
    the location, cost and procedures for using the
    facilities, and also of the consultation
    arrangements for future development of adequate
    facilities within the port

WASTE TRANSFER and DISPOSAL
  • Concept of duty of care
  • Any holder of controlled wastes has duty to
  • Take all measures to prevent the escape of waste
    from their control
  • Ensure that all waste is transferred only to an
    authorised contractor
  • Ensure that all relevant documentation is
    completed

SPECIFIC DISPOSAL PROVISIONS
  • The amount of garbage stored at any time should
    not exceed 20 cu m
  • It should not be stored for more than 7 days
  • Dirty ballast should not exceed 30 dwt
  • Waste mixtures containing oil should not exceed
    1 dwt

CHARGING
  • EU Directive says ALL vessels should be charged
    for use of facilities irrespective of actual use
  • In UK ship currently pays as and when it needs
    reception facilities
  • Change of emphasis puts port in driving seat

EFFECT OF CHANGE
  • Port faces penalties for breach of legislation
  • Commercial complications of detaining vessel for
    perceived non-discharge
  • Shipper may seek compensation

OVERRIDING RESPONSIBILITY
  • Port must establish fail safe 24 hr per day, 365
    days per year system of waste reception
    facilities and the collection and disposal of
    waste

REVIEW
  • Aim to ensure that port waste management
    facilities are relevant and are up to date,and
    that plans are implemented effectively
