• Old Law finally comes to an End

• The 105-year old law holding a fine of 75 was
  brought to an end when Rosevilles Timothy Boomer
  was tried in court that day.

• Back in 1998, Boomer was canoeing in the Rifle
  River in Arenac County when his boat tipped over.

• Boomer began cursing and nearby family, including
  Michael and Tammy Smith and their children, only
  3 and 5 years old, could hear this profanity.

• Under the cussing statute, it is illegal to use
  profanity in front of children, and Boomer was
  then convicted back in June 1999, to pay the 75
  fine.

• The case finally appealed, and questions of First
  Amendment Rights were brought up.

• People are still questioning whether the courts
  decision to appeal the case was the right one.
