The Dignity in Care campaign was launched by the
Department of Health in 2006. It aims to
stimulate a national debate around dignity in
care and end tolerance of services that do not
respect the dignity of those using them.
Dignity is about interpersonal behaviours as
well as systems and processes

The DH is creating a social movement of people
who go that extra mile. We will never improve
dignity in care if we restrict that role to a
chosen few. Such a cultural change cannot be
dictated by passing laws but is achieved by
highlighting and sharing good practice.

There were many complaints from patients and
relatives about the quality of nursing care.
These primarily related to patients not being
fed, call bells not being answered, patients left
in soiled bedding, medication not being
administered, charts not being completed, poor
hygiene and general disregard for privacy and
dignity. Worryingly, the trusts board appeared
to be largely unaware of these.

Many staff that we interviewed volunteered their
view that the approach of the trust meant that
the care of patients had become secondary to
achieving targets and minimising breachesWe
analysed the minutes of the trust's board
meetings from April 2005 to 2008. The minutes
indicated that discussion at the board was
dominated by finance, targets and achieving
foundation trust status.

We heard about nurses leaving meetings in tears
and being threatened that their jobs were at
stake due to the number of breaches. One nurse
described an average shift as "pressure,
pressure, pressure". Many staff that we
interviewed volunteered their view that the
approach of the trust meant that the care of
patients had become secondary to achieving
targets and minimising breaches.

Elderly people in nursing homes are being left in
shocking pain, with two in five saying they are
in constant agony, and others admitting to having
suicidal thoughts (average age 82 years)
Eight percent described their pain as
excruciating. One 95 year old woman said, I cry
every night nearly, the pain so bad.
More than 8 in 10 said no doctor or nurse had
ever talked to them about how the pain could be
treated, and 57 percent had never been asked
about their pain by other nursing home staff.
When there were discussions, these often excluded
them and took place between nurses and GPs.

Martin died on 21 December 2005, aged 43 years
old, allegedly of a stroke. He had a severe
learning disability and no speech. In the 26 days
he spent in hospital following a stroke he went
without food. The hospital failed to use a nasal
feeding tube at the critical time to prevent his
condition from deteriorating dangerously. This
left him too weak to undergo surgery to have a
PEG feeding tube inserted into his
stomach. Martins family has complained to the
hospital and to the Healthcare Commission.

Memorial hospital Action Group, have all raised
serious concerns regarding the care and treatment
that was afforded to thirteen relatives between
1997 and 2001. It is of concern that yet again
serious questions are asked about the conduct of
health care professionals, the failure of the GMC
to act and the failure of the police to carry out
a thorough investigation

The CPS
After looking at all the evidence including
that of experts and seeking advice of counsel,
I decided there was insufficient evidence for a
realistic prospect of conviction to prosecute
anyone for gross negligence manslaughter over the
deaths of 10 patients at the hospital. I offer
my deepest sympathies to the families for their
bereavements.

Framework legislation addresses the parameters
and structures within which safeguarding and
adult protection systems and processes are
constructed. It establishes powers and duties
within which agencies collaborate, share
information and work together.
Intervention legislation addresses the powers and
duties of interaction between adult protection
processes and the individual citizen. It
potentially could impact upon an individuals
right to choice and control in certain situations.
