Scope of the ISA Scheme
  • Employers have responsibilities for 2 types of
    activity
  • Regulated
  • Controlled

Regulated Activity -1
  • Close contact with children or vulnerable adults
    and is of a specified nature (i.e. teaching).
  • Close contact with children or vulnerable adults
    and is in a specified place (e.g., schools, care
    homes)
  • where the activity is frequent or intensive.

Regulated Activity - 2
  • Fostering and Childcare.
  • Certain defined positions of responsibility
    (e.g., School Governor, Director of Social
    Services, Childrens Charity Trustee).
  • No distinction is made between paid and voluntary
    work.

Regulated Activity - 3
  • Someone who is not ISA registered cannot legally
    be employed in regulated activity.
  • ISA status should be checked before employment.

Controlled Activity
  • Support worker in Education, Social Care, health
    settings (e.g. cleaner, catering).
  • Those working for specified organisations (e.g.,
    a Local Authority with frequent access to
    sensitive records).

Duty to Refer Information
  • LAs have a statutory duty to refer relevant
    information.
  • Information must be referred if an individual has
    harmed, or may harm, a child/ vulnerable adult.
  • As soon as it is known.

The ISA Scheme Operation - 1
  • Information continuously updated.
  • Employer notification.
  • Scheme membership portable.

CRB - Eligibility
  • Positions which include regular contact with
    children/vulnerable adults.
  • Meet specific provisions exceptions order.
  • Member of relevant local government body.
  • Further information awaited.
