PHILIPS COMPLAINT TO THE COMMISSION OF THE
EUROPEAN COMMUNITIES CONCERNING THE FAILURE OF
THE KINGDOM OF SPAIN TO COMPLY WITH COMMUNITY
LAW
Philips realizes that the EC Commission is well
aware of the obstacles to intra-Community trade
that the diverging and disproportionate national
"fair compensation" generate for the
ICT-industry. In fact, the objections of Philips
relating to the Spanish levy system are mirrored
more generally in the Commission's report on the
assessment it made of the fair compensation
systems in the Member States. The Commission
Staff Working Document with the title "Fair
Compensation for Private Copying in a Converging
Environment of December 20061 provides a
detailed analysis of the barriers to trade
generated by the current national systems and the
significant harm to the EC economy as a whole and
the ICT-sector in particular. The Commission
concludes that the barriers to trade contravene
Article 28 of the EC Treaty and that there is no
justification in the sense of Article 30 EC
Treaty for those systems.
