Jurisdictional Complaints Filed
  • 70 75 deal with standard of care.
  • Senate Bill 104 became law in 2003. This law
    requires all standard of care cases to be
    reviewed by at least two expert panelists.
  • The expert panelists are Board Certified, engaged
    in the active practice of medicine in Texas,
    practice in the same or similar area as the
    physician being investigated.
  • Two panelists must agree that the physicians
    care either met or did not meet the standard of
    care.

TMB RULE CHANGE
  • All Expert Panelists will be asked to watch a
    tutorial describing the duties and
    responsibilities of a panelist.
  • All Expert Panelists must pass an examination
    based on the tutorial.
  • Upon passing the exam, the panelist will receive
    1 hour of Category I Ethics CME.
  • Each panelist will receive a maximum of 6 hours
    of Category I CME credit per year for the work
    they do in serving as a panelist.
