Purpose
  • To familiarize individuals who may come in
    contact with Restricted Data and Formerly
    Restricted Data with the procedures for
    identifying, classifying, marking, handling, and
    declassifying documents containing that
    information as required by the Atomic Energy Act
    and 10 CFR Part 1045

Categories of Classified Information
  • Restricted Data (RD)
  • Formerly Restricted Data (FRD)
  • National Security Information (NSI)

E.O. 12958 does NOT apply to RD and FRD
  • Section 6.2(a) specifically excludes RD/FRD from
    ALL provisions of the Executive order, including

    with a declassification date or event (even if
    NSI is present)
  • Positive action by an authorized person is
    required to declassify RD or FRD documents

Restricted Data
  • The Atomic Energy Act defines Restricted Data
    as all data concerning
  • Design, Manufacture, or Utilization of Atomic
    Weapons
  • Production of Special Nuclear Material or
  • Use of Special Nuclear Material in the Production
    of Energy

but shall not include data declassified or
removed from the Restricted Data category
pursuant to section 142

Transclassification
  • The term Restricted Data means all data
    concerning the design, manufacture, or
    utilization of atomic weapons the production of
    special nuclear material or the use of special
    nuclear material in the production of energy

but shall not include data declassified or
removed (transclassified) from the Restricted
Data category pursuant to section 142

    from the Restricted Data category after DOE and

  • 1) relates primarily to the military utilization
    of atomic weapons and
  • 2) can be adequately safeguarded as defense
    information

RD Management Officials
  • Heads of Agencies with access to RD and FRD
    designate RD Management Officials who
  • Designate RD classifiers and ensure RD
    classifiers have appropriate training and
    guidance
  • Ensure persons with access to RD and FRD have
    appropriate training

Classification of RD and FRD Documents
  • Documents generated in an RD or FRD subject area
    require a classification review
  • Review must be by an RD Classifier

If intended for public release, documents that
have the potential to contain RD require a review
by DOE prior to release documents that have the
potential to contain FRD require a review by DOE
or DoD prior to release.

Requirements for RD Classifiers
  • RD Classifiers must
  • Be designated in writing by position or by name
    as an RD Classifier by an RD Management Official
  • Be knowledgeable in the subject area(s)
  • Be trained in RD and FRD classification policy
    (RD Classifiers Course)
  • Possess appropriate classification guidance

Requirements for RD Classifiers DoD Exception
  • Any member of the military, DoD civilian, or
    designated DoD contractor may classify an RD or
    FRD document if they
  • Have access to RD or FRD
  • Are knowledgeable in the subject area(s)
  • Have received training
  • Possesses appropriate classification guidance

Designation must be in writing by the RD

Critical Nuclear Weapon Design Information
(CNWDI)
  • A category of weapon data used by DoD to
    designate TSRD or SRD revealing the theory of
    operation or design of the components of a
    thermonuclear or fission bomb, warhead,
    demolition munitions, or test device
  • Access to CNWDI is on a need-to-know basis
  • Special DoD briefing is required
  • Documents containing CNWDI must be marked and
    stored accordingly

Handling RD and FRD Documents
  • Storage requirements are the same as for NSI
  • Procedures for mailing RD and FRD are the same as
    NSI at comparable classification levels
  • Only TS, SAP, and use control information must
    fall under an accountability system
  • Loss or compromised RD or FRD must be reported to
    DOE
  • Recommend do not mix with NSI documents scheduled
    for automatic declassification

International Exchange Limitations
  • There shall be no exchange of RD or FRD with any
    nation or regional defense organization unless
    specifically authorized by the President pursuant
    to an agreement for cooperation entered in
    accordance with section 123 and subsection 144.b
    of the Atomic Energy Act.

No Comment Policy
  • Classified information may appear in the public
    domain
  • Fact itself is classified
  • Does not make it unclassified
  • Must not comment on the accuracy, classification,
    or technical merit of the information

Challenges to Classification
  • Any person with access to RD or FRD may challenge
    an RD Classifiers decision
  • The RD Classifier must respond within 90 days
  • Appeal to RD Classifiers response can be made to
    DOE
  • There will be no retribution

Sanctions
  • Any knowing, willful, or negligent action
    contrary to the requirements of 10 CFR Part 1045
    which results in the misclassification of
    information may result in sanctions
  • Appropriate criminal, civil, and/or
    administrative penalties for misclassification
    violations
  • Administrative sanctions possible for other
    violations of the policies and procedures of 10
    CFR Part 1045

  • Restricted Data Classifiers Course
  • Covers policy and procedures of being an RD
    Classifier. It is offered through the DOE for
    educational purposes only. To become an RD
    Classifier, individuals must contact the RD
    Management Official for their agency.
  • RD/FRD Recognition and Records Processing Seminar
  • To qualify individuals to conduct page-by-page
    reviews of historical records under E.O. 12958
    that are not likely to contain RD/FRD.
    Instructor led or videotape and study package
  • Certification Course for Historical Records
    Restricted Data Reviewers
  • 4 day instructor led course required for
    individuals conducting page-by-page reviews of
    historical records under E.O. 12958 in
    collections likely to contain RD/FRD
