  • What is a request for an EXCEPTION to the
    Bilingual Education Program?
  • Chapter 89.1205 requires that each school
    district which has an enrollment of 20 or more
    limited English proficient students in any
    language classification in the same grade level
    district-wide shall offer a bilingual education
    program
  • Chapter 89.1205 requires that districts and
    charter schools that are unable to provide a
    bilingual education program due to staffing
    request from the Commissioner of Education an
    exception to the bilingual education program and
    approval to offer an alternative program by
    submitting Form 1.

  • What is a request for an WAIVER to the English
    as a Second Language Program?
  • Chapter 89.1205 requires that all limited English
    proficient students for whom a district is not
    required to offer a bilingual education program
    shall be provided an English as a second language
    program regardless of the students' grade levels
    and home language, and regardless of the number
    of such students.
  • Chapter 89.1205 requires that districts or
    charter schools unable to provide an ESL
    certified teachers to implement the ESL program
    are required to request from the Commissioner of
    Education a waiver of the certification
    requirements for teachers who will provide ESL
    instruction by submitting Form 2, Request for
    Waiver for English as a Second Language (ESL)
    Program.

  • What are the certification requirements for an
    ESL program?
  • K-8 ESL programs, teachers of LEP students must
    be ESL certified (29.061)
  • 9-12 teachers may have ESL certification and/or
    intensive sheltered instruction training (Letter
    from Commissioner Alanis, Dec. 7, 1998).
  • ESOL 1 and 2 teachers must hold ESL certification
    (Alanis letter Dec. 1998).

  • What are the certification requirements for an
    Bilingual program?
  • Bilingual education teachers must hold a
    bilingual generalist certification (29.061)
  • EC-4 Bilingual
  • 4-8 Bilingual

Considerations for Elementary Bilingual Campuses
  • If a bilingual district has an elementary grade
    level that is departmentalized and only one
    teacher is bilingual certified, that teacher must
    be in a self-contained setting and is responsible
    for teaching ALL content areas.

What about Dual Language Programs?
  • In a dual language classroom where teachers are
    team teaching, do both need to be certified in
    Bilingual or ESL?
  • The teacher who provides content area instruction
    in the primary language needs to be bilingual
    certified.
  • The teacher providing content area instruction in
    English needs to be ESL certified. 89.1210(b)
    and 89.1210(c)

  • Currently, the deadline for submitting exceptions
    and waivers is Oct. 1.
  • This may change to Nov. 1.
  • Charter schools staff must meet state
    certification requirements for bilingual and ESL
    programs.

  • Currently, 9 Region XIII districts applied for an
    exception in the 07-08 school year. 5 districts
    and 2 charter schools applied for a waiver during
    the 07-08 school year.
  • TEA compares applications for exceptions and
    waivers from school year to school year.

  • If you applied for an exception to the bilingual
    program
  • TEA expects you to decrease at least 25 of the
    number of teachers under Spanish exception for
    the upcoming school year and meet the goals
    specified in your approved action plan to reduce
    the number of bilingual teachers under exception.

  • If you applied for an waiver to the ESL program
  • TEA expects you to have the teachers who you
    submitted a waiver for complete certification
    before May 2008..

  • If you submitted a teachers name in the
    Exception/Waiver paperwork last year, you may not
    submit their name again in 08-09 school year.

  • Can a district or charter school use permanent
    substitute teachers to teach LEP students?
  • Only if these teachers have valid Texas teaching
    certificates and are properly Bilingually
    certified or ESL supplemental certified as
    required by the program that the district or
    charter school is required to implement.

ARD/LPAC Collaboration - Entry
  • TAC 89.1225(f)(4)
  • Key members of the admission review and dismissal
    (ARD) committee in conjunction with key members
    of the language proficiency assessment committee
    shall determine an appropriate assessment
    instrument and designated level of performance
    for indicating limited English proficiencyfor
    students for whom those tests would be
    inappropriate as part of the individualized
    education program (IEP). The decision for entry
    into a bilingual education or English as a second
    language program shall be determined by the ARD
    committee in conjunction with the language
    proficiency assessment committee

ARD/LPAC Collaboration - Entry
  • The decision is made that the student is LEP or
    not LEP, pending the results of the remaining
    assessments that special ed. is giving the
    student.
  • Based on the LEP assessments, the student is
    served pending the results of the special
    education assessments.
  • The student is entered in PEIMS as LEP, and if
    there is a change after the key members of the
    ARD committee and key LPAC members meet, then
    change the code in PEIMS.

  • On 3/27/08, the TEA announced the upcoming
    availability of TAKS interactive study guides in
    a letter to districts. As stated in that letter,
    TEA will be gradually rolling out the interactive
    guides, starting with the SSI grades (3, 5, and
    8).

  • Region XIII is developing an ELPS Toolkit to help
    educators implement ELPS with their daily
    instruction. Look for toolkit and training in
    Spring of 09.

  • ELPS Tip of the Month
  • 74.4b4 School districts shallprovide intensive
    and ongoing foundational second language
    acquisition instruction to ELLs in grade 3 or
    higher who are at the beginning or intermediate
    level of English language proficiency in
    listening, speaking reading, and /or writing as
    determined by the states English language
    proficiency assessment system.
  • These ELLS require focused, targeted, and
    systematic second language acquisition
    instruction to provide them with the foundation
    of English language vocabulary, grammar, syntax,
    and English mechanics necessary to support
    content-based instruction and accelerated
    learning of English.
