4MODERNISING CUSTOMS CODE WHY?
- The present Community Customs Code, Council
Regulation (EEC) No. 2913/92 is out of date - The Code has been repeatedly and substantially
amended since its introduction - No general revision has been made of the present
Code since it was adopted 1992
5MODERNISING CUSTOMS CODE WHY?
- Communication from the Commission on a simple and
paperless environment for customs and trade -
- Community's trade facilitation agenda in the
context of the Doha Development Agenda - Amendment to the International Convention on the
simplification and harmonization of customs
procedures
6MODERNISING CUSTOMS CODE WHY?
- Current customs legislation and processes are
generally complicated - Customs procedures are based on paper
declarations - There is still no obligation to use computerized
systems
7MODERNISING CUSTOMS CODE WHY?
- ! Customs legislation should reflect the new
economic reality and the new role and mission of
customs -
- ! There is a need for complete replacement by a
- modernized Community Customs Code

- Progressive versions of the draft modernized
Customs Code have been discussed with - Member States
- Customs administrations in the Customs Code
Committee - European trade federations, in Trade Contact
Group meetings, since May 2004 - on the Internet during the summer of 2004

- Facilitation of legitimate trade

10WHAT PURPUSES TO MODERNISE?
- simplify legislation and administration
procedures both from the point of view of customs
authorities and traders - to promote further the uniform application of
customs legislation - to ensure the basis for efficient and simple
clearance procedures - to ensure an effective decision-making process
for the adoption of implementing provisions,
guidelines and explanatory notes
11WHAT PURPUSES TO MODERNISE?
- to introduce a centralized customs clearance
arrangement - to facilitate communications between traders and
customs - to facilitate business, save money and time in
business transactions with customs - to increase the competitiveness of companies
doing business in Europe
12WHAT PURPUSES TO MODERNISE?
- to introduce an electronic, paper-free customs
environment - to make Member States' electronic customs systems
compatible with each other - to introduce EU-wide electronic risk analysis
- faster and better exchange of information between
European customs authorities - to improve information exchange between frontier
control authorities

- to ensure security and safety at the external
borders of the Community - to minimize the occurrence of risk to the
Community, its citizens and its trading partners

15HOW MODERNISE ? Replacement by a modernized
Community Customs Code and its implementing
provisions together with the relevant Regulations
- - Council Regulation (EEC) No 918/83 of 28 March
1983 setting up a Community system of reliefs
from customs duties, - Council Regulation (EEC) No 3925/91 of 19
December 1991 concerning the elimination of
controls and formalities applicable to the cabin
and hold baggage of persons taking an
intra-Community flight and the baggage of persons
making an intra-Community sea crossing,
- Council Regulation (EC) No 82/2001 of 5
December 2000 concerning the definition of the
concept of "originating products" and methods of
administrative co-operation in trade between the
customs territory of the Community and Ceuta and
Melilla, Council Regulation (EC) No 1207/2001
of 11 June 2001 on procedures to facilitate the
issue of movement certificates EUR.1, the
making-out of invoice declarations and forms
EUR.2 and the issue of certain approved exporter
authorizations under the provisions governing
preferential trade between the European Community
and certain countries.
16HOW MODERNISE ?
- fewer provisions and simpler rules
- provide for more coherent terminology
17HOW MODERNISE ?
- provide for radical reform of customs import and
export procedures - to reduce their number
- to provide common and simple rules for the
special procedures (transit, storage, specific
use and processing) - to provide a small set of rules for each category
of special procedure -
18HOW MODERNISE ?
- extend the use of single authorization
- use of a single guarantee for all categories of
special procedures - to avoid errors and to reduce the number of
post-release recoveries and repayments
19HOW MODERNISE ?
- simple, rapid and standard customs procedures and
processes - use of simplified declarations
- providing for only one type of simplified
declaration
20HOW MODERNISE ?
- favors the lodging, registering and checking of
the customs declaration prior to the arrival of
the goods - dissociation of the place where the declaration
is lodged from the place where the goods are
physically located - to provide for centralized clearance at the place
where the economic operator is established
21HOW MODERNISE ?
- to establish the legal principle that electronic
declarations becoming compulsory, and paper-based
declarations becoming the exception - IT systems for customs operations offer, in each
Member State, the same facilities to economic
operators - common risk management framework and an
electronic system for its implementation as a
bases for harmonized application of customs
controls
22HOW MODERNISE ?
- authorized economic operator
- single window
- one stop shop
23HOW MODERNISE ?
- to ensure an appropriate level of effective,
dissuasive and proportionate sanctions throughout
the Internal Market
24ENTRY IN TO FORCE
