3WEEE Directive - Summary
- Producer Responsibility Directive to address a
priority waste stream - Gives responsibility for the collection,
treatment and reprocessing of WEEE to producers - Distributors have obligations to provide
facilities for consumers to dispose of their
electrical products - Directive emphasises the need to prioritise
re-use of products.
4The UK regulations will
- Place direct obligations for collection treatment
and reprocessing on Producers based on market
share and level of WEEE arising - An annual compliance period ie 1 January 31
December (except first period in 2007 ) - An evidence based system of reporting both for
compliance and UK reporting to the Commission - Require distributors to provide appropriate
facilities for consumers.
5What is a producer?
- For the purpose of WEEE Regulations you are a
producer if- - You manufacture electrical and electronic
equipment (EEE) selling under your own brand
within the UK - Sell EEE under your own brand within the UK which
has been manufactured by someone else - You import EEE for sale on the UK Market
6Producers obligations - Household
- Obligations will be based on market share and
levels of WEEE arising within a compliance period - Producers required to join compliance scheme to
discharge their obligations - Producer Compliance Schemes (PCS) will collect,
and transport for treatment and reprocessing,
WEEE left at public DCFs or other collection
facilities. - Producers are responsible for financing this
activity via PCS.
7Producer Obligations -Non Household
- Obligations will relate to individual EEE Sales
and WEEE arising - Producer/compliance schemes will deal directly
with the end-user when products reach their end
of life - Orphan WEEE will be the responsibility of the
end-user under EPA Duty of Care regulations
8Role of Compliance Schemes
- Schemes will register their members with the
appropriate environmental agency annually - Register of producers will be a public document
- Schemes will be responsible for collection,
transportation, treatment and reprocessing of
WEEE in line with the obligations of their
Members - Presenting Declarations of Compliance with
supporting evidence, to the appropriate
environmental agency
9Common issues arising from Consultation
- Safeguards for small business how can we ensure
they are treated proportionately by schemes No
exemptions within the Directive - Evidence options to simplify
- Re-use in particular reporting requirement
- Individual Producer Responsibility How can we
address this
10EU Review
- Review scheduled for 2008 to look at and possibly
revise targets within the Directive - Now likely to be a more fundamental review into
the requirements of the Directive - Overall timetable not yet clear
11Next Steps
- Consultation will close on the 17 October
- Responses as early as possible please!
- Engagement with stakeholders will continue
- Regulations will be laid before Parliament early
December 2006 and will come into effect early
2007 - Guidance will be revisited and revised as a
result of the consultation and the discussion
with stakeholders on the practical details
