management supervision by those bodies or having
an administrative, managerial or supervisory
board, more than half of whose members are
appointed by the State, regional or local
authorities, or by other bodies governed by
public law.

Sort and role of Partners

Some features 10 ERDF flexibility rules
- It can be considered for the involvement of two
sorts of partners - ERDF LP or ERDF PP in case of expenditure
incurred for the implementation of a project or
part of it in countries outside the EU, part of
the Programme area - non EU PP of the programme area (10 Partner)
for the implementation of specific activities of
the project, not financed by IPA resources in the
same project.

Some features 20 ERDF flexibility rules
- Bodies located within the EU but outside the
programme area can be involved in the projects in
two different ways, depending on the project
structure - involvement of the partner as Financing Partner
(20 ERDF Partner) with separate budget and
related financial responsibility - involvement of the partner as strategic partner
in the form of Associated Strategic Partner (so
called EU Associated 20), without separate
budget but significant strategic role within the
project.

Conditions for the involvement of 20 ERDF
Partner
- Condition of the participation of the 20 ERDF
Partner is that an Agreement (MoU) is concluded
between the Member state where the partner is
located and the programme management bodies (MA,
CA, AA). This Agreement shall ensure that the
MSs control and audit procedures and the related
legal system meet the requirements set up by SEE
Programme 2007 2013. The MoU will be concluded
between the MA and the respective national
authorities after approval of the project. - 2. Involvement in the project of ERDF Partners
located outside the Programme area but within the
EU territory is possible only in specific cases,
where such expenditure is for the benefit of the
regions of the Programme area. This benefit
should be clearly demonstrated and justified.
Applicants will also need to demonstrate that the
project cannot be implemented without the
involvement of the 20 ERDF Partner due to
geographical or thematic reasons.

- no specific budget restrictions at project
level - the ERDF co-funding is based on public
contribution only! - IPA and ERDF contribution is 85
the allocation is indicative and not binding

- Results and impact has to leave a significant
footprint in the whole project area
29 I have an idea, is it transnational?
- If it is relevant for your institution, region,
country from a strategic point of view - If it complies to the strategy of the SEE
programme and its priorities - If it is also relevant for other institutions
within the countries of SEE - If you find the right partners within the SEE
eligible area to implement it (at least one of
them should come from a member state) - If you are sure that your idea can only be
implemented through a transnational partnership
30 Partnership
- The partnership dimension should be well
justified and able to contribute in a balanced
manner to the implementation of the project - Relevant and reasonable geographical coverage
- Importance of the horizontal coverage of the
different levels of government and vertical
linkages to other sectors - Its the relevance (expertise) of the partners
and not their number to make the partnership
ideal - Relevance of decision-making bodies to strengthen
the project results and sustainability

- Relevant thematic idea which links the members of
the partnership at the transnational level - Joint concrete co-operation projects with a
result-oriented approach (not simple exchange of
experiences and know-how transfer) - Clear methodological approach strong cohesion
between objectives/activities/outputs and results - Clear transnational focus on the SEE area
- Better transfer of project results higher

32Involving IPA participants
- IPA Partners are representing added value both to
the programme and to the quality of a proposal
however - Good communication should be ensured between the
ERDF Lead Applicant and IPA participants for a
successful proposal - ERDF Lead Applicants should involve IPA
participation based on the real requirements of
the project - ERDF Lead Applicant should take into
consideration the experience and field of
expertise of the IPA participants
33IPA participants some suggestions
- The ERDF partners should carefully consult the
potential IPA PPs on eligibility. In case there
is more than one IPA PP and one is ineligible the
IPA contract for that country will not be
eligible, which might hinder the quality of the
project. - In case more than two PP (either ERDF or IPA) are
not eligible or are rejected for other
eligibility reasons, the full proposal is
considered as not eligible. Therefore, IPA
Partners eligibility should be carefully checked
before involving them.
