INTRODUCTION
  • The purpose of the presentation is to explain the
    RC-BM Bill, 2005 submitted to the Portfolio
    Committee for consideration.
  • It must be noted that irrespective of what
    decision is taken regarding the future of CBM,
    the preliminary demarcated boundaries that have
    been taken into account for the ward delimitation
    process must be authorized by this legislation
    for purposes of and in preparation for the
    forthcoming local government elections.
  • It must further be noted that the proposed
    boundary changes to the boundaries of cross
    boundary municipalities must be authorized by
    legislation before such boundaries are finally
    demarcated.

BACKGROUND TO THE BILL
  • Section 2 of the LG Cross-boundary
    Municipalities Act, 2000 authorises the
    redetermination of boundaries of cross-boundary
    municipalities.
  • (a) with the concurrence of the legislatures of
    the provinces involved and
  • (b) if the redetermination is authorised by
    national legislation.
  • The purpose of this Bill is therefore to
    authorise a number of redeterminations.

REDETERMINATIONS
  • The nature of these redeterminations in terms of
    the Municipal Demarcation Act, 1998 are simple
    though technical, such as the inclusion/exclusion
    of farm areas from municipalities.
  • A number of redeterminations relate to the
    alignment of municipal boundaries with Surveyor
    General cadastres.
  • The Bill therefore authorises the
    redeterminations and amends the LG
    Cross-boundary Municipalities Act, 2000 by
    replacing the existing Schedule describing
    cross-boundary municipalities with a Schedule
    reflecting the redeterminations.
