  • ObjectiveTo understand the scope of the powers
    of Congress in a governmental system that is both
    limited and federal in character.

A. Congressional Power
  • 1. Congress has only those powers delegated to it
    and not specifically denied to it by the
    Constitutionwhich Amendments underline that
    fact?
  • 2. Congress has expressed, implied and inherent
    powers.

B. Strict v. Liberal (loose) Construction
  • 1. Strict constructionists believe congress
    should exercise only its expressed powers and
    those implied powers absolutely necessary to
    carry out those expressed powers.
  • These are the original Democratic-Republicans.

  • 2. Liberal (loose) constructionists believe in a
    broad interpretation of the powers given to
    Congress, an interpretation that has extended the
    powers of the federal government far beyond the
    the plans of the original framers of the
    Constitution. These are the original Federalists.
