Background Information and Summary of Violations

• The lot was previously developed with a season
  camp and several accessory structures. With the
  exception of two driveways, the lot was well
  vegetated with trees, shrubs, and a lawn area
  beginning at the NHWM.
• In 2003, the Leavitts filled or graded
  approximately 8,500 feet of the lot beginning 20
  feet from the lake.
• Ground cover in the affected area was removed or
  destroyed.
• They did not promptly stabilize the exposed soil
  according to the Commissions requirements.
• During a subsequent meeting at the site in July,
  Mr. Leavitt agreed to apply seed and mulch
  immediately and to plant trees and shrubs
  according to the terms of a settlement.
• Follow-up inspections in 2003 and 2004 showed
  that grass was well established throughout the
  filled or graded areas.

Settlement Conditions

• The Leavitts will pay 2,000 civil penalty.
• By July 30,2005, they will dismantle and properly
  dispose of the 68 foot long cement block
  retaining wall adjacent to the shoreline. The
  wall was installed by prior owners.
• By August 30, 2005, reestablish 50 vegetated
  buffer within 50 feet of the NHWM and then ensure
  its survival.
• Record this agreement within 30 day of its
  ratification.
