Teaming Arrangements
  • There is no limit on team size but only 9
    entities per team (as identified by the offeror)
    will be evaluated
  • Failure to ID the 9 entities MAY MAKE YOU
    NONRESPONSIVE
  • Each Prime team (up to a maximum of 9 entities)
    must have capabilities in each category of work
  • Modifications/Upgrades/Enhancements
  • Maintenance/Repair
  • 60 days proposal response time

Industry Feedback
  • 50 of the work performed by the prime must be
    demonstrated in each of the following proposal
    submissions
  • Pricing Proposal (Labor Material distribution)
  • Past Performance information (Details to be
    provided in the RFP)
  • The Government intends to award without
    discussions
  • We strongly suggest that everyone go to their SBA
    for teaming approval

  • The distinction between an 8a joint venture and
    this effort 8a joint venture must be approved
    by SBA. This effort will be reviewed by
    WR-ALC/JA (legal office)

Relevancy Definitions
  • Relevancy definitions applicable to the prime
    contractors (including, in the case of a joint
    venture, each joint venture member) regarding
    actual work performed and subcontractor/team
    management are as follows
  • Very Relevant - Present/past performance efforts
    included prime/joint venture members who
    performed modifications/upgrades/enhancements and
    maintenance/repair while managing subcontractors
    who also performed modifications and/or upgrades
    and/or enhancements and/or maintenance and/or
    repair, which involved essentially the same
    magnitude of effort and complexities this
    solicitation requires

    includes the technical features and
    characteristics identified in the Performance
    Work Statement (PWS), but also the logistical and
    programmatic considerations including, but not
    limited to, work performed on military aircraft
    and/or military aircraft systems and subsystems
    (i.e. mechanical, electronic and structural),
    and/or the commercial derivatives of the military
    aircraft and/or military systems/subsystems

Ostensible Subcontracting
  • The PCO is required to make a size determination
    on the apparently successful offeror for every
    competitive D/TO
  • In the event that a prime contractor proposes to
    use a large business subcontractor on a specific
    D/TO, and that prime contractor is determined to
    be the apparently successful offeror on that
    D/TO, the PCO will review the offerors proposal
    to determine if an ostensible subcontracting
    relationship exists
  • In the event that the determination is made that
    an ostensible subcontracting relationship exists,
    that offeror will be determined to be large by
    affiliation and will be ineligible for award of
    that D/TO
  • PCO will utilize the SBA developed seven factor
    test in making this determination

Ostensible subcontractors - the Test
  • The Seven Factor test used by SBA includes the
    following
  • Which party will be managing the contract?
  • Which party possesses the requisite background
    and expertise to carry out the contract?
  • What party pursued the contract award?
  • What degree of collaboration was there on the
    proposal effort?
  • Were the tasks allocated to be performed by each
    party or is there commingling of personnel and
    material?
  • What is the amount of work to be performed by
    each party?
  • Which party will perform the more complex and
    costly contract functions?

Exercise of Incentive Option
  • Satisfactory performance Option exercised
  • Unsatisfactory performance Option will not be
    exercised
  • Performance is unsatisfactory when contractor or
    joint venture work performed falls below 50 of
    the basic contract
  • Non compliance at the end of the first year of
    the option period may result in suspension from
    competition
  • Government will not exercise the option of any
    prime contractor who becomes a large business
    during the course of the basic contract period of
    performance
