Background Information

• July 2002 Amendment A to BP 10234 issued to
  Gagnon for a 10 foot by 32 foot camper trailer, a
  lakeside deck, a shed, and a combined system.
• July 2003 I found 3 campers trailers on the
  site, two of which did not comply with road and
  water body setbacks. A filled/graded area of
  7,400 sq. ft. was not stabilized. Fill/graded
  area extends from road to 74 feet inland of the
  lake.
• July 2004
• -Additional fill/grade approximately
  5,000 sq. ft., some in areas that were
  partially stabilized in 2003. The new fill/grade
  areas not stabilized.
• -The two unapproved campers are removed.
• August 2004 The approved camp and deck are on
  the site. Most of the site is stabilized with
  grass and trees planted adjacent to the road. A
  small amount of import fill remains less that 100
  feet from the lake.

Summary of Violations

• 12 M.R.S.A. Section 685-B,1,A Construction
  without a permit (two camper trailers).
• 12 M.R.S.A. Section 685-B,5 Failure to comply
  with the terms and conditions of a permit.
• Standards, Section 10.27,F,1 Fill/grade more
  than 5,000 sq. ft. less than 250 from a
  waterbody.
• Special Condition 5, BP 10234 Structures less
  than 100 feet from lake and less than 50 feet
  from road.
• BP 10234 Special Condition 7 Failure to
  provide LPI certification for installation of
  septic system. 4

Settlement Conditions

• Pay a civil penalty of 600
• By 9/30/04 move shed to a location 100 feet from
  the NHWM of Long Lake.
• By 9/30/04 stabilize all remaining areas of
  disturbed or exposed soil according to Commission
  requirements.
• Comply with the terms and conditions of BP 10234.
