Developmental Delay Definition
  • The NMAC section 6.31.2.10 (F) defines
    Developmental Delay as the following
    Developmentally Delayed is a classification for
    children aged 5 through 9 who do not qualify for
    special education under any other disability
    category. Documented Delay in development which
    are at least 30 below chronological age or who
    in judgment of the IEP team and one or more
    qualified evaluators needs special education or
    related services in at least one of the 5 areas
  • Receptive or expressive language
  • Cognitive disabilities
  • Gross and or fine motor functioning
  • Social or emotional development
  • Self help/adaptive functioning

The Law
  • NMAC establishes that the use of developmentally
    delayed classification for children aged 3
    through 9 may be used at the option of individual
    local education agencies, but may only be used
    for children who do not qualify for special
    education under any other available disability
    category.
  • Children must be re-evaluated in the school year
    in which they turn 9, and will no longer be
    eligible in this category when they turn 10. At
    this time if student doesnt qualify under any
    other category they will no longer be eligible
    for special education and related services.

5 Developmental areas effected
  • Physical Development- fine gross motor such as
    writing, cutting, coloring, running, jumping,
    moving, etc.
  • Cognitive Development conceptual development,
    creativity, thinking, reasoning, problem solving
  • Communication Development- expressive and
    receptive language use, articulation, voice,
    fluency, etc.
  • Social or Emotional Development- express feelings
    under normal circumstances, interaction, ability
    to establish interpersonal relationships,
    responses to social expectations, sharing, etc.
  • Adaptive Development- conceptual, social, and
    practical skills, such as toileting, dressing,
    eating, self care, etc.

Important things to know
  • Developmental Delays are defined by each state.
  • Know the Law for the state you are in
  • Early intervention is always the best in helping
    the child outgrow their developmental delay.
  • When children are retested at age 9 and show no
    signs of delay in any of the developmental
    categories they will not be diagnosed with a
    disability.
