Title: Process for Handling Suspected Violations

1
Process for Handling Suspected Violations
Suspected Violation Reported
Students and faculty are obligated to report
suspected violations to the Honor Code Committee
(HCC) or the Assistant Dean for Academic Affairs.
The KSA VP of Academic Affairs will conduct an
investigation. All interviews will be conducted
under the supervision of the HCC Chairs, the
Assistant Dean, and one non-voting member of the
HCC. All names of people interviewed during the
investigation will be kept confidential from the
remaining HCC members.
Violation Investigated
The HCC will meet to determine whether a student
hearing is warranted by a majority vote. The four
voting HCC members will not know the accuseds
name nor the witnesses interviewed. The decision
to proceed with a student trial will be based
solely on the facts collected during the
investigation. A student hearing will proceed
with a majority vote in favor of a student
hearing.
Student Hearing Determined
Student Hearing Conducted
No Further Action Required
If a majority vote cannot be obtained, a student
trial will not occur and the case concludes. All
evidence is destroyed.
A hearing will be held by a panel of 8 randomly
selected Kellogg students. The HCC chairs will
facilitate the hearing. The KSA VP of Academic
Affairs will present the results of the
investigation and the charged person will be able
to respond and present its case.
No Further Action No Sanctions
Violation Determined Sanction(s) Recommended
At least 7 of 8 panel members must find the
accused responsible for violating at least one of
the four Kellogg Honor Code tenets. The student
panel will also recommend the appropriate
sanction(s), which include, but are not limited
to loss of student rights, required service,
reduced grade, probation, suspension, and
expulsion. At least 7 of 8 panel members must
agree on the sanction(s).
If two (2) members of the student panel cannot
determine whether the accused violated a tenet of
the Honor Code, the case concludes and all
evidence is destroyed.
