Powers of the Courts
  • More sentencing considerations such as
  • Review of company assets.
  • Cost of the investigation and prosecution can be
    assigned.
  • Courts can set the terms of probation i.e.
    restitution, publication, require
    establishment of policies and procedures to
    reduce risks and reduce the likelihood of
    further criminal acts, and communication of these
    policies to employees.
  • Identify a senior officer to be responsible for
    compliance with probation orders. Require
    progress reports.

Due Diligence
  • What constitutes due diligence will depend on the
    circumstances of each case. Generally, the
    employer can establish due diligence by
    demonstrating they developed a proper system to
    prevent the commission of the offence. Courts
    examine if the employer has considered facts such

  • Reviewed foreseeable workplace health and safety
    risks
  • Developed policies and procedures to prevent
    harm from
    potential risks
  • Implement and maintain disciplinary guidelines
