EVOLUTION OF H1B VISA
  • Began in the 1950s to attract intelligent and
    educated individuals during the Cold War
  • U.S. economy currently demands 1.6 million
    workers per year
  • US legislature approved 45,000 more annual H1B
    visas in 2000 due to increased demand

VISA TYPES
  • An immigrant visa is the visa issued to persons
    wishing to live permanently in the United States.
    These are popularly known as "Green Cards".
  • A nonimmigrant visa is the visa issued to persons
    with permanent residence outside the U.S. but who
    wish to be in the U.S. on a temporary basis.
    (The H1B visa  is a non-immigrant visa.)

TYPES OF H-VISAS
  • H-1B1 - Up to 3 yrs Increment of up to 3 years.
    Total stay limited to 6 years
  • H-1B2 - Up to 3 yrs Increment of up to 3 years.
    Total stay limited to 6 years, with some
    exceptions
  • H-1C - Up to 3 yrs Total stay limited to 3
    years
  • H-2A/B - Same as validity of labor certification,
    with maximum of 1 year. Total stay limited to 3
    years
  • H-3 - Special Education Training-up to 18 months
    Other Trainee-up to 2 years

RECOMMENDATIONS
  • Restrict the eligibility for H1-B visas
  • Reduce the labor period from 6 years to 2 years
    and bar renewal applications
  • Require employers to make efforts to fulfill
    positions with U.S. workers first
  • Require nonimmigrants holding H1-B visas to leave
    the US for a minimum of 1 year following the
    expiration of that visa
  • More limitation on and monitoring of skill-based
    temporary immigration programs
