Background Information
  • Prior Development Cliff/Segees leased lot was
    developed with a pre-Commission nonconforming
    seasonal camp 46 feet from the normal high water
    mark of Aziscohos Lake.
  • October 1991 GP 453 authorized approval to
    install riprap along the shoreline to prevent
    further erosion from storm wave action. Amendment
    A, issued in 1993, granted an extension of time
    to finish.
  • December 2001 BP 11204 denied after-the-fact
    approval for the installation of of the permanent
    foundation since there were no recognized factors
    on the lot to prevent locating the camp and
    permanent foundation to a more conforming
    location.

Description of Activities and Violations
  • In 1999, Cliff/Segee constructed or caused to be
    constructed, a permanent foundation under their
    existing pre-Commission seasonal camp, and
    reconstructed a 9 foot by 18 foot portion of the
    camp, without obtaining a permit from the
    Commission.
  • Cliff/Segee also cleared all vegetation and
    filled and graded the area of the lot along both
    sides of the camp and between the camp and the
    lake.

Settlement Conditions
  • Pay a civil penalty of 6,500.
  • By August 30, 2005, reestablish and maintain a
    well vegetated buffer of trees and shrubs within
    the existing clearing between the camp and the
    shoreline of Aziscohos Lake, and along both sides
    of the camp within 100 feet of the shoreline.
  • Development of the lot is limited to the existing
    structure in its current location.
  • The property may not be transferred without the
    prior approval of the Maine Bureau of Parks and
    Lands and then such transfer shall be made with
    full disclosure of this agreement.

Conclusion
  • Staff believe this agreement is fair and
    consistent with the Commissions Compliance and
    Enforcement Policy and request that you ratify
    the agreement.

Additional Information
  • Bureau of Parks and Lands staff have surveyed the
    lot lines and it appears that the Cliff/Segee
    camp actually straddles the side property line.
    Whereas the original camp was constructed was
    constructed before 1971, this is not necessarily
    a concern with the Commissions rules and
    standards. However, BPL staff intend to do some
    field work this summer/fall to consider the
    feasibility of establishing a new common side
    boundary line.
  • Bureau of Parks and Lands staff also propose to
    conduct a compliance inspection of the property
    at a later date. This inspection shall include an
    internal inspection of the camp.
