Title: Initial Concepts for Proposed Regulation XXXV

1
Initial Concepts forProposed Regulation XXXV
  • Working Group Meeting
  • February 9, 2005

2
Background
  • Diesel particulate identified as a Toxic Air
    Contaminant (TAC) since 1998
  • Long-term exposure to diesel particulate poses
highest cancer risk of any TAC evaluated by OEHHA
  • ARB conducted JR Davis Rail Yard study in
    Roseville
  • High cancer risks (500 in a million)
  • Idling represented 45 of diesel particulate
    emissions
  • Locomotives are significant sources of criteria
    pollutants

3
Objective of Reg XXXV
  • Monitor and record locomotive idling
  • Reduce locomotive idling
  • Conduct emissions inventory and health risk
assessment at major rail yards in the Basin
  • Reduce the cancer risk from diesel sources at
major rail yards in the Basin

4
Proposed Rules
  • PR 3500 - General
  • PR 3501 - Recordkeeping For Locomotive Idling
  • PR 3502 - Locomotive Idling Minimization
  • PR 3503 - Diesel Risk Assessment For Rail Yards
  • PR 3504 - Rail Yard Risk Reduction

5
Applicability
  • Locomotives
  • Class I freight railroads
  • Switching and terminal freight railroads
  • Operated in the Basin
  • Four railroads meet applicability
  • Railyards
  • Major rail yards in the Basin
  • Operated by Class I and switching and terminal
    freight railroads
  • 7 rail yards

6
PR 3500 - General
  • Key definitions
  • Rely on existing regulatory definitions to extent
    feasible

7
PR 3501 Recordkeeping
  • Purpose
  • Monitor and report locomotive idling
  • Identify unnecessary idling
  • Inform public of idling events
  • Idling Monitoring and Recording Plan
  • Submit Jan. 1, 2006
  • Identify methods to monitor, record, and transmit
    idling data to the District
  • Methods to calculate emissions

8
PR 3501 Recordkeeping (Continued)
  • Recordkeeping and Reporting
  • Effective July 1, 2006
  • All locomotives idling more than 15 minutes
  • Times and dates of idling events
  • Reason for idling
  • Explanation of any idling event mitigation that
    is preempted by federal law
  • Estimated idling emissions

9
PR 3501 Recordkeeping (Continued)
  • Reporting requirements
  • Submit daily records to the District
  • Quarterly and annual report
  • Maintain records for 2 years
  • Public Notification
  • Conduct public notification every 6 months
  • Exemption for locomotives with anti-idling
devices that limit idling time below 15 minutes

10
PR 3502 Idling Minimization
  • Purpose
  • Minimize duration, frequency and exposure to
    diesel particulate from locomotive idling
    minimize criteria pollutant emissions
  • Idling Minimization Plan
  • Submit July 1, 2006
  • Identify strategies for all locomotives to
  • Reduce duration of idling to lt 15 minutes
  • Reduce frequency of idling events, and
  • Reduce exposure to idling events

11
PR 3502 Idling Minimization (Continued)
  • Idling Minimization Plan (Continued)
  • Schedule to implement strategies
  • Provide expected emission reductions
  • Explanation why specific idling event cannot be
minimized due to preemption by federal law
  • Annual progress reports on idling reduction

12
PR 3503 Risk Assessment
  • Health Risk Assessment Plan
  • Submit January 1, 2006
  • Diesel particulate emissions inventory and Health
    Risk Assessment
  • Applicability
  • Rail yard
  • Includes all onsite diesel equipment
  • Yard hostlers, forklifts, trains, etc.

13
PR 3503 Risk Assessment(Continued)
  • Updates
  • Emission inventory annually
  • Health Risk Assessment if emissions increase
  • Public notification requirement
  • Cancer risk gt10 in one million

14
PR 3504 Risk Reduction
  • Submit Risk Reduction Plan
  • Required if PR 3503 risk level gt 25 in one
    million
  • Due within 180 days of an approved HRA
  • Evaluation of risk reduction measures and
    implementation schedule
  • Evaluation of residual risk after measure
    implementation
  • Annual progress report

15
PR 3504 Risk Reduction(Continued)
  • Community Air Emissions Action Plan
  • Submit January 1, 2006
  • Designation of Community Liaison
  • Schedule for community briefings
  • Protocol for complaint resolution
  • Fence Line Monitoring
  • Monitoring program to measure diesel particulate
    at fenceline

16
Rule Development Schedule
