  • To qualify for 5,000 the borrower must be a
    highly qualified full-time elementary or

  • To qualify for 17,500 the borrower must be a
    highly qualified full-time mathematics or
    science teacher, or elementary or secondary
    special education teacher

    language or bilingual education, or areas of
    expertise designated as shortage areas by a state
    education agency

  • Low-income school that qualifies for Title I
    funding and more than 30 of their enrolled
    students qualify for services under Title I
  • Listed in Annual Directory of Designated
    Low-Income Schools for Teacher Cancellation

  • Perkins Only
  • Specified fields of expertise that the state has
    designated as a shortage area

  • FFEL/DL and Perkins
  • List of eligible schools is available May 1st
  • If not available, the Secretary uses the
    preceding years list

Prevention of Double Benefits
  • FFEL/DL and Perkins
  • No borrower may, for the same service, receive a
    benefit under both this subsection and Subtitle D
    of Title I of the National Community Service Act
    of 1990 (Americorps)

Prior Teaching Service

  • One of the years of the qualifying teaching
    service must be after receipt of the loan for
    which forgiveness is sought

  • Cannot qualify for cancellation of a loan
    received during the period that the borrower
    performed services for which cancellation is
    sought

  • No refund of payments made by borrower (or on
    behalf of borrower) on canceled loans

    there was a school error in not granting
    cancellation

Defaulted Loans
  • FFEL/DL
  • May be forgiven if satisfactory repayment
    arrangements have been made with the holder of
    the loan
  • Perkins
  • May be forgiven unless loan was accelerated, then
    only the service provided prior to acceleration
    is forgiven
  • If defaulted loan has been rehabilitated,
    borrower may apply for cancellation
