A Very Short Tribal History
  • The Cow Creek Band of Umpqua became the first
    Oregon Treaty Tribe on September 19, 1853 after
    one day of negotiation with Chief Miwaleta.
  • Western Oregon Indian Termination Act of 1954
    terminated about 67 tribes. This one act
    terminated more Tribes than all other termination
    acts combined.
  • On December 27, 1982, President Reagan signed
    into law restoration of the Cow Creek Band of
    Umpqua Tribe of Indians and established formal
    relations with the United States Government
    through its trust agency, the Bureau of Indian
    Affairs.

Persistence
  • After the Treaty was signed until the restoration
    act, the Tribe endured epidemics, the stress of
    economic and cultural dislocation, as well as the
    militia hired by the Office of Indian Affairs to
    essentially exterminate them.
  • Scattered individuals and families remained in
    the remote outlying regions of the watershed, and
    others returned from the reservations.
  • Through it all the Tribal Government stayed
    intact.

Tribal Government
  • The Cow Creek Band of Umpqua Tribe of Indians is
    a government with rights and responsibilities
    toward its citizens.
  • The Tribe has their own constitution that is
    separate and distinct from the Constitution of
    the United States.
  • The Tribal government upholds tribal sovereignty
    and strives to protect our history and culture.

  • Much of the Tribes history and culture is
    interconnected with our ancestral lands.

Government to Government
  • All projects within this designated area should
    have tribal notification and consultation.
  • The Tribe meets with ODOT staff quarterly to
    exchange information.
  • Each ODOT region has a designated tribal liaison.
  • ODOT staff is required to report to the
    Commission on Indian Services on their Government
    to Government relations with Tribes every year.

  • Local ODOT personnel has really stepped up and
    involved the Tribes Cultural and Natural
    Resource programs in the early stages of bridge
    development, maintenance, and planning.
  • Monthly meetings with ODOT and county personnel,
    the environmental subcontractors, and the
    archaeological subcontractors limits
    opportunities for miscommunication.
