  • Section 303(d) of the CWA and 40 CFR Part 130
    specify requirements for identifying impaired
    waters and developing TMDLs to address the
    impairments
  • Waters determined to be impaired are included on
    the States 303(d) list
  • The list is revised following public comment
    every 2 years
  • The 2008 303(d) list was approved by EPA Region
    4 on April 22, 2008
