  • The 228 massacre that
  • happened in Taiwan in
  • 1947 will never be
  • forgotten, either.

  • human rights were,
  • are, and will be always
  • respected under the
  • laws of the USA. All of
  • the Americans are
  • proud of the fact that
  • they are Americans.
  • But, what about the
  • Taiwanese people who
  • were killed by the KMT
  • after World War II?

  • On Sept. 2, 1945, Gen MacArthur directed
  • Chiang Kai-shek (CKS) to come to Taiwan
  • to accept the surrender of Japanese troops.

While the Japanese surrender ceremonies on Oct.
25, 1945, were conducted on behalf of the Allies,
the ensuing military occupation of Taiwan was
conducted on behalf of the "conqueror" and
"principal occupying power" , and that is the
United States.

  • Hence, CKS was only exercising delegated
  • administrative authority for the military
  • occupation of Taiwan.  As the principal
  • occupying power, United States Military
  • Government (USMG) has begun in Taiwan
  • as of Oct. 25, 1945.

  • In the post war San Francisco Peace Treaty of
  • April 28, 1952, Japan renounced the sovereignty
  • of Taiwan, but no receiving country was
  • designated. Taiwan remains under the
  • jurisdiction of USMG.  The US flag should be
  • flying.
  • As of late April 1952, the ROC flag should have
  • come down, and the US Commander in Chief
  • should have issued an Executive Order for the
  • "Republic of China" in Taiwan to disband.

  • As of late April 1952, Taiwan's international
    legal
  • position is clear.   The United States is the
  • "conqueror," the United States is the "principal
  • occupying power," and there has been a
    territorial
  • cession in the peace treaty. 
  • Taiwan is "unincorporated territory under USMG,"
  • which is the exact same legal position as Puerto
  • Rico, Guam, the Philippines, and Cuba
  • immediately after the coming into effect of the
  • April 11, 1899 treaty which ended the Spanish
  • American War.

  • The Taiwanese people are entitled to "fundamental
  • rights" under the US Constitution, in the same
    fashion
  • as for other persons living in US Overseas
    territories,
  • and even without any action by Congress.
