• Conviction of sexual assault or attempted sexual
  assault makes you a sex offender

DoD Definition

• Consent shall not be deemed or construed to
  mean the failure by the victim to offer physical
  resistance
• Consent is not given when a person uses force,
  threat of force, coercion or when the victim is
  asleep, incapacitated, or unconscious.
• Majority of sexual assaults involve alcohol

• Under the influence of alcohol

USMC Military Justice

1. UCMJ Art. 120 - Marines convicted of covered
   offenses are designated military sexual
   offenders
2. Requires sex offenders to register with State and
   local authorities
3. Requires military officials to notify State
   officials upon release, discharge or transfer of
   Marines

Sex Offender Sanctions

• Loss of voting rights
• 25-years on the Sex Offender Public Register
• Loss of VA benefits
• Ineligible for college grants or scholarships
• Ineligible to own firearms
• Felony record destroys credit rating (unable to
  get mortgage or car loans)
• Ordered where to live and with whom
• Difficulty finding a willing landlord
• Monetary restitution to the victim
• Court ordered sex offender treatment, at your
  cost
• Difficulty securing jobs
• Chronic under-employment
