Introduction to the issues
Just as the real estate market at the local level
differs from that at the national, so do the
issues and regulations throughout the various
levels of government. Fortunately, you have
heavyweights like the NJAR Government Affairs
Department and RPAC on your side.
When burdensome legislation is introduced and our
industry faces conflict in the political arena,
rest assured that NJAR and RPAC are working to
protect your livelihood and the rights of
property owners throughout the state.
Take a look at some of the state, federal and
local issues that yielded favorable results or
are in the works, thanks to the RPAC team.

State issues
NJAR initiated a measure to ban private transfer
fees (PTFs) from being passed onto homebuyers of
newly constructed homes. Had NJAR not defeated
these fees, developers would have been able to
require that a percentage of the final home sale
be paid to a private entity every time the
property is sold for up to 99 years after the
propertys construction. Fortunately, this new
law bans that practice and also creates
disclosure requirements so that consumers buying
a property with a PTF will be aware of any fees
prior to purchasing a home.
PRIVATE TRANSFER FEE (PTF)
NJAR successfully helped pass the Blue Acres
law, which allows municipalities to purchase
homes in flood-zones by submitting to the voters
a proposition authorizing an annual levy or using
current open space funds. This new law will speed
up the buyout of these properties so homeowners
can receive a fair value for their property.

State issues
Each year, NJAR monitors the state budget
process to protect the real estate industry and
private property owners from threatening
proposals in the form of taxes and fees. As New
Jersey anticipates budget battles in the years to
come, NJAR will continue to fight on your
behalf.
STATE BUDGET
NJAR successfully helped pass a law exempting
one and two family homes from bulk sales
requirements. Prior to enactment, the bulk sales
requirement led to countless transactions being
delayed and thousands of dollars being required
to be held in escrow, both of which were
responsible for home sales falling through.

Contributions are not deductible for income tax
purposes. Contributions to RPAC are voluntary and
are used for political purposes. You may
contribute more or less than the suggested
amount. You may refuse to contribute without
reprisal and the National Association of
REALTORS or any of its state associations or
local boards will not favor or disfavor any
member because of the amount contributed. 70 of
each contribution is used by RPAC of New Jersey
to support state and local political candidates.
Until RPAC of New Jersey reaches its RPAC goal,
30 is sent to National RPAC to support federal
candidates and is charged against your limits
under 2 U.S.C. 441a after RPAC of New Jersey
reaches its RPAC goal it may elect to retain your
entire contribution for use in supporting state
and local candidates.
