Tasmanian Risk Management Fund (TRMF)
  • Tasmanian Governments
    self-insurance fund
  • Established on 1 January 1999
  • Managed by inter-agency Steering Committee
    administered by TRMF Unit at Treasury
  • Agencies pay annual contributions to TRMF to meet
    claims costs

  • Personal injury (workers compensation personal
    accident)
  • Property (general property, vehicles, marine
    hull)
  • Liability (general medical)
  • Miscellaneous (travel government contingency)

Responsibilities
  • TRMF Unit administers Fund Committees and
    finances, provides risk management information
    advice to agencies, produces quarterly
    newsletter, facilitates training, undertakes
    projects
  • Marsh undertakes claims management, provides
    advice to Government on risk management, reports
    to agencies and TRMF
  • Agencies ensure safe working environment,
    develop internal policies, instruct Marsh and
    have ultimate responsibility for management of
    claims

Personal accident - cover
  • No-fault personal injury cover for people who are
    not covered by workers compensation (ie who are
    not employees of an agency) if they suffer or
    aggravate an injury which arises out of, and in
    the course of, their service to the government,
    or contract a disease for which their services to
    the government was the major contributor
  • Includes authorised agency volunteers under an
    agencys control

  • Factors evidencing agency control
  • individual/group being appointed directly by the
    agency
  • existence of a high level of agency supervision
    over the activities of the individual/group and
  • agency having the power to dismiss the
    individual/group

  • Does not apply to volunteers
  • deemed to be workers under the Workers
    Rehabilitation and Compensation Act 1988 (WRCA)
    or
  • entitled to benefits in accordance with the WRCA
    under certain legislation
  • section 71 Nature Conservation Act 2002
  • section 17 Whales Protection Act 1988
  • Volunteers who fall under categories above to be
    treated as workers and full WRCA benefits apply

Personal accident - benefits
  • Calculated in accordance with the Workers
    Rehabilitation and Compensation Act 1988,
    including
  • lump sum benefits (for death and permanent
    incapacity)
  • weekly benefits (replacing loss of wage or
    salary) and
  • other reasonable costs and expenses (including
    rehabilitation)
  • 2 year limit on benefits

  • Cover does not extend to costs expenses
    recoverable from Medicare or a private health
    insurer
  • Motor Accidents Insurance Board (MAIB) provides
    no-fault benefits to persons who suffer personal
    injury as a result of a motor accident

Liability - cover
  • Under Civil Liability Act 2002 individual
    volunteers acting in good faith are exempted from
    liability arising from his/her negligence
  • Agency directing volunteer incurs liability
  • Third party public liability cover provided to
    agency where claim arises out of volunteers
    negligence
  • Cover is not provided where a volunteer
  • acts outside scope of activities authorised by
    agency, or contrary to its instructions or
  • is affected by alcohol/other drugs at time of
    incident

Property - cover
  • Cover for loss of, or damage to (excluding normal
    wear and tear) property owned by an agency, eg
    vehicles, equipment etc
  • TRMF does not cover
  • volunteers personal property or
  • private vehicles and vessels
