  • 1st ten amendments to the Constitution (1791)

Amendment 1 5 freedoms
  • A. Freedom of speech, religion, press, petition,
    assembly
  • 1. your freedoms cannot harm another persons
    rights or freedoms
  • a. Ex. Libel (writing lies about someone)
  • b. Ex. Slander (saying lies about someone)
  • 2. your freedoms cannot endanger the govt
  • a. Ex treason
  • 3. Freedom of religion
  • a. Wall of separation separation between
    church (religion) and state (govt)
  • b. Establishment clause Congress is not
    allowed to establish (endorse) any religion

  • Amendment 2 the right to bear arms
  • Amendment 3 you have the right to deny military
    housing ( they can not take your home)
  • Amendment 4 you are protected from unreasonable
    search and seizure

Amendment 5 rights of people accused of a crime
  • A. due process fair and equal treatment
  • B. protected from self-incrimination (do not have
    to say anything that may make you look guilty)
  • C. protected from double jeopardy (can not be
    tried twice for same crime)
  • D. eminent domain the govt CAN take you
    private property for public use as long as you
    are compensated

  • Amendment 6 you have the right to a (1) fair
    and speedy trial , (2) the right to know charges,
    (3) trial by jury, and (4) the right to a lawyer
    (legal counsel)
  • Amendment 7 civil case if you sue for more
    than 20 you have the right to a jury trial

  • Amendment 8 you are protected from (1) cruel
    and unusual punishment and (2) excessive bails
    and fines (punishment must fit the crime)
  • Amendment 9 rights reserved for citizens
  • Amendment 10 reserved powers for states
    (anything not written in the Constitution is
    reserved for states)
