SB 430, effective 7/1/04, generally exempts
Morgan from COMAR Title 21 and Division II, State
Finance and Procurement Article. BPW approval
will still be required for Morgans Procurement
Policies and Procedures and service and capital
improvement contracts exceeding 500,000
Effective 10/18/99, regulations exempt the
University System of Maryland from COMAR Title 21
and Division II, State Finance and Procurement
Article (See 11-203(e) State Finance and
procurement Article), except Board of Public
Works approval is required for those service
contracts and capital improvement contracts that
exceed 500,000.
NOTE Board of Public Works approvals not
required for commodity contracts. BPW approval
required for the following contracts over
25,000 real property leases, capital equipment
and construction related services. BPW approval
required for the following contracts over
200,000 services, information technology,
construction, maintenance and A/E services. A
Control Agency may both procure on its own behalf
and control procurements by other agencies for
categories listed. A Primary Procurement Unit
that is not a Control Agency may procure on its
own behalf, but does not control other agencies
procurements.
