  • What are they?

What are the continuation notices?(Schedule 18,
paragraph 7 and 20 of the Communications Bill)
  • Licences revoked on 24 July 2003
  • Some conditions will continue in order to fill
    the gap
  • Also any Direction, Determination or Consent
    given or made for the purposes of the continued
    condition

Why do we have to use continuation notices?
  • To deal with a gap in the regulatory regime
  • Market reviews will not now be implemented on 25
    July 2003
  • We can only notify the European Commission after
    25 July 2003 of the outcome of market reviews

When do we have to make the continuation notices?
  • Before 23 July 2003
  • The timeframes are quite tight because
  • We have to identify licence conditions which
    must be continued
  • Also any Directions, Determinations and Consents
    made under them

Consultation
  • If possible we will consult publicly on the
    continuation notices - 14 days consultation
  • We will discuss with the operators concerned
  • May have to limit ourselves to joint meetings
    with groups of operators
  • Might be only one notice per operator

The way forward
  • Notify the Commission and NRAs under Articles 6
    7 of the Framework Directive on or soon after 25
    July 2003
  • Commission has one month to respond
  • Can require 2 more months
  • Could veto a market review conclusion

Conclusions
  • Continuation notices could be in force for
    several months
  • They will be discontinued by a subsequent notice
  • When the market review is finalised
