Patent Registration in India | Patent Filing in India (1)

Description:

A patent is a form of intellectual property that gives exclusive right granted for an invention – a product, making, selling and importing an invention for a limited period of years, patent Act 1920, Designs Act 2000, and Trademark Act 1999 and Copyright Act 1957. A patent provides patent owners with protection for their inventions. Protection is granted for a limited period, generally 20 years. The first step in determining whether to protect a new product or invention with a patent is to understand the costs and benefits of patent protection. Patent rights are usually enforced in courts that, in most systems, hold the authority to stop patent infringement. Conversely, exploiting the subject matter outweighs the high costs of prosecuting and protecting the patent. – PowerPoint PPT presentation

What is a Patent?
A patent is a form of intellectual property that
gives exclusive right granted for an invention
a product, making, selling and importing an
invention for a limited period of years, patent
Act 1920, Designs Act 2000, and Trademark Act
1999 and Copyright Act 1957. A patent provides
patent owners with protection for their
inventions. Protection is granted for a limited
period, generally 20 years.

What kind of protection do patents offer?
The first step in determining whether to protect
a new product or invention with a patent is to
understand the costs and benefits of patent
protection. Patent rights are usually enforced in
courts that, in most systems, hold the authority
to stop patent infringement. Conversely,
exploiting the subject matter outweighs the high
costs of prosecuting and protecting the patent.
5
What rights do patent owners have?
The owner of a patent can do the following with
their patent rights (a).License the patent
rights to one or more third-parties to collect
royalties. (b).Sell the patent rights Sue a
patent infringer. (c).Manufacture, offer for
sale, sell or use a product covered by the
patent without infringing the patent. (d).If an
inventor is not the owner of the patent the
inventor will have none of these rights.
