Historical Background
  • Spanish rule was severe and exploitative and
    occasional rebellions were harshly suppressed. It
    was US intervention during the Spanish-American
    War in 1898 that finally overthrew Spanish rule.
    The subsequent Treaty of Paris established Cuban
    independence, which was granted in 1902 after a
    three-year transition period. Fidel Castro led a
    rebel army to victory in 1959 his iron rule has
    held the regime together since then. Cuba's
    Communist revolution, with Soviet support, was
    exported throughout Latin America and Africa
    during the 1960s, 1970s, and 1980s.
  • Due to the communist ideas of Fidel Castro, the
    relations between US and Cuba were deteriorated
    and they stablished and embargo to Cuba.

  • In April the UN Commission on Human Rights passed
    a relatively mild resolution on human rights in
    Cuba. However, the resolution was supported by
    many Latin American countries and for the first
    time Mexico voted in favour, prompting a
    diplomatic row with Cuba. In November, for the
    11th consecutive year, the UN General Assembly
    passed a resolution calling on the USA to end its
    embargo.

Violations ofHuman rights
  • One of the most serious violations of human
    rights and that occurs in Cuba, is violation of
    the right to freedom of expression. Article IV of
    the American Declaration of the Rights and Duties
    of Man states that
  • "Every person has the right to freedom of
    investigation, of opinion, and of the expression
    and dissemination of ideas, by any medium
    whatsoever.
  • People is taken to prision because of their
    ideas goes against the 3rd article of the human
    rights declaration that talks about freedom and
    the article 9 that says that no one can be
    arrested without a good reason.
  • People are not allowed to go out of Cuba whenever
    and wherever they want to, this goes agains the
    article 13 of the human rights declaration that
    says that everyone has the right to circulate
    freely and to have the decision of where they
    want to live.

  • Cuba retains the death penalty for several crimes
    and adopted it for two additional crimes in early
    1999. Human Rights Watch opposes capital
    punishment as an inherently cruel practice often
    carried out in a discriminatory manner.
  • Cuban minors risk being forced to serve as
    soldiers. The Cuban armed forces conscript minors
    as young as sixteen.
  • Cuba confines its sizable prison population under
    substandard and unhealthy conditions, where
    prisoners face physical and sexual abuse.
  • The Cuban government exercises strict control
    over labor rights. Cuba not only bans independent
    labor groups and harasses persons attempting to
    form them but also factors criticism of the
    government into hiring and firing decisions. This
    goes against the article 23rd of the human rights
    declaration that talks about the freedom of
    everyone to choose thier own job, the right of a
    reasonable wage, etc.

Recommendations
  • Make new legal reforms to improve the human
    rights situation.
  • Cease all prosecutions based on the individual's
    exercise of fundamental rights to free
    expression, association, and movement.
  • Reform its Criminal Code, repealing or narrowing
    the definition of all crimes that are in
    violation of established international human
    rights norms and practices.
  • Implement the Convention against Torture and
    Other Cruel, Inhuman or Degrading Treatment or
    Punishment, by making torture a crime and
    investigating, prosecuting, and punishing all
    government officials who employ torture.
  • Restructure its court system to establish
    judicial and prosecutorial independence.
