Letter Ballot from September
  • At the September SASB Meeting Series, a
    recommendation from PatCom was made to the SASB
    to change a part of the clause 6 of the Bylaws
    and the corresponding language of the Ops Man.
  • Bylaw changes require a 2/3 majority
  • We didnt receive responses from even 2/3 of the
    SASB members.
  • Therefore, we must now consider the following

    the following change to the SASB Bylaws

  • 12 LoA forms received posted
  • 0 LoA letters received posted
  • 3 requests made for 8 LoAs

ANSI Patent Policy
  • No consensus has been reached on any changes to
    the ANSI Patent Policy
  • A meeting of the group was held in mid-October in
    the DC. Among other agenda items, I presented
    the work the IEEE SASB Patent Committee is doing.

Proposed Policy Changes
  • In preparation for the December PatCom meeting, a
    series of updated proposals for changes to the
    SASB Bylaws, the SASB Ops Manual and the LOA form
    were developed for consideration at the PatCom
    meeting.
  • These proposals were developed to address issues
    discussed at the September PatCom meeting.
  • These proposals were circulated to PatCom and
    others in advance. Some changes to the proposals
    were made before the meeting in response to
    PatCom and legal counsel comments.

PatCom Meeting
  • The PatCom meeting was again well attended by
    guests from many high profile IT and TeleComm
    companies.
  • A highly interactive discussion was once again
    held on each of proposed areas of change
  • One of the changes was approved and the others
    were either explicitly tabled until the next
    PatCom meeting or deferred for lack of time.
  • During the course of the meeting, PatCom
    discerned at least some partial consensus on some
    of the issues and will work between meetings to
    further refine these proposals.

Recommended Changes
  • One recommendation was approved by PatCom to
    modify the Bylaws, clause 6, to make the
    assurance irrevocable once submitted.
  • A letter ballot will be issued to the SASB after
    this meeting to approve this recommendation for
    submission to the SA BoG.

Tabled Changes
  • The following proposed changes were tabled or
    deferred until the March PatCom meeting
  • Survival of Assurances after mergers,
    acquisitions, etc.
  • Applicability of LOAs to amendments and revisions
  • Inclusion of not to exceed rates on the LOA
  • Amendment of claims / subsequent discovery of
    patents once the patent holder is on notice
  • A language change to the LOA to create a defined
    term Essential Patent Claims and use that
    term through the LOA instead of repeating the
    common text.

Moving Forward
  • To facilitate discussion between meetings, a
    mailing list and web site are being created.
  • Mailing list pp-dialog_at_ieee.org
  • Website http//grouper.ieee.org/groups/pp-dialog
  • The website will include an archive of the
    mailing list as well as reference materials and
    drafts of the material being considered.
  • PatCom may meet on the Monday prior to the next
    SASB meeting series to enable a more complete
    discussion.
