2Replaces all previous Education Codes in Family
Life/Sex Education,STDs and HIV/AIDS prevention
instruction.
3 Became effective January 1, 2004
4Purpose of this ActTo provide a pupil with the
knowledge and skills necessary to protect his or
her sexual and reproductive health from
unintended pregnancy and sexually transmitted
diseases. Education Code 51930
5Purpose of this ActTo encourage a pupil to
develop healthy attitudes concerning adolescent
growth and development, body image, gender roles,
sexual orientation, dating, marriage, and family.

6Family Life and Sexuality Education instruction
is not mandated. HIV/AIDS instruction is
mandated.
7Education Code 51933Sexual Health Education
8If you do conduct Family Life/Sexuality Education
you must abide by the entire Education Code. You
may not pick and choose topics.
9If you do conduct Family Life/Sexuality
Education, it must begin by the 7th grade.
10Not in previous Education CodeInstruction and
materials shall be appropriate for use with
pupils of all races, genders, sexual
orientations, ethnic and cultural backgrounds,
English learners and pupils with disabilities.
11Not in previous Education Code Instruction and
materials shall encourage a pupil to communicate
with his or her parents or guardians about human
sexuality.
12Previous Course material and instruction shall
teach honor and respect for monogamous
heterosexual marriage.New Instruction and
materials shall teach respect for marriage and
committed relationships.
13Not in previous Education Code Instruction shall
provide information about the effectiveness and
safety of all FDA-approved contraceptive methods
in preventing pregnancy, including, but not
limited to, emergency contraception.
14Not in previous Education Code Instruction and
materials may not teach or promote religious
doctrine.
15Not in previous Education Code Instruction and
materials may not reflect or promote bias against
any person on the basis of any category protected
by Section 220 of the Education Code.

- Materials and instruction on the possible
emotional and psychological consequences of sex
outside of marriage and consequences of unwanted
pregnancy - Materials and instruction that stress abstinence
until marriage

- Materials and instruction on laws pertaining to
financial responsibility for children born out of
wedlock - Materials and instruction that advise pupils
about unlawful sexual relations with males or
females under 18 to whom them are not married

of personal behavior - Materials and instruction on how to avoid
unwanted physical and verbal sexual advances and
how to say no -

20Instructional content remains the same. However,
instruction must conform to Sex Education Codes
by being appropriate to students of all races,
gendersEnglish learners, age-appropriate, not
promote religious doctrine etc.
21Parents must be notified at the beginning of the
school year,have opportunity to review
materials, learn affiliation of guest speakers,
and exempt their child from instruction.
22 Education Code 51935 In-Service Training
School districts are still required to provide
in-service training for all school district
personnel delivering HIV/AIDS instruction.
Collaboration with County Offices and CDE is
encouraged.
23 Education Code 51936 In-service training
for comprehensive sexual health is not required.
It is, however, recommended.
24Allows for contracting with outside consultants
with expertise in sexual health and/or HIV/AIDS,
including those who have developed multilingual
curricula and curricula accessible to persons
with disabilities to deliver instruction or
provide training.
25Education Code 51938Parent Consent/Excuse
26Eliminates requirements to notify parents no less
than 10 days and no more than 15 days prior to
having guest speakers present or deliver
instruction on HIV/AIDS, STDs, human sexuality,
or family life.
27New Anonymous, voluntary, and confidential
research and evaluation tools to measure pupils'
health behaviors and risks, including tests,
questionnaires, and surveys
28about the pupil's attitudes concerning or
practices relating to sex may be administered to
any pupil in grades 7 to 12, inclusive, if the
parent or guardian is notified in writing. Parent
may request in writing that his/her child not
participate.
