MEC 7 Process
  • Available to
  • A person whose name does not appear on the Voters
    roll for that voting district
  • That person claims to have applied for
    registration in that voting district
  • Person must have applied ON or BEFORE the date
    the Voters Roll closed for that election
  • Person must apply on the prescribed form (MEC 7)

  • Person must submit proof of application for
    registration (i.e. only the application for
    registration receipt in the ID).
  • The application for registration receipt must
  • - indicate VD number for that VD

    objection, including whether to order a recount.

    objector and other parties involved.

    each objection and decision.

  • Objection concerning any aspect of the election
    that is material to the declared result.
  • Who Any interested party.
  • When Served (i.e. post, telegram, fax, e-mail
    or by hand) on the Commission at its office in
    Pretoria before 17h00 on the second day after
    voting day.
  • To Notice in writing to the Commission
    containing the information as per Section 65 of
    the Municipal Electoral Act.

Objections Material to the Results
  • Proof of service of copies of the notice and
    annexures on other parties involved in the
    objection.
  • Commission will investigate and decide the
    objection.
  • The objector and all involved parties will be
    informed of the decision.
  • Appeal within 3 days of Commission decision to
    the Electoral Court.

Party Agents
  • A registered party contesting the elections may
    appoint 2 agents per voting station and an
    independent 1 agent per station.
  • If counting takes place at a venue other than the
    voting station, a party may appoint 4 agents and
    an independent 2 agents per venue.
  • An agent must be a South African citizen and may
    not be a party or ward candidate in the election.

  • A party or independent candidate must issue the
    agent with written proof of appointment and give
    notice to the presiding officer or counting
    officer.
  • A party or independent candidate may revoke the
    appointment by serving a revocation of
    appointment and give notice to the Presiding
    Officer and Counting officer.

  • Party agents are allowed to observe proceedings
    concerning voting, counting and determination and
    declaration of results.
  • May not interfere with the proceedings.
  • May lodge objections or bring irregularities to
    the attention of the Presiding Officer.

  • The absence of agents does not invalidate
    proceedings.
  • Agents and candidates must comply with orders
    given by the Presiding Officer.

Election Day Activity
  • On Voting Day NO political event such as
    marches, public meetings, rallies and
    demonstrations ANYWHERE
  • On Voting Day within the boundary of the Voting
    Station no political activity whatsoever,
    except casting a vote.
  • A Voter can wear any apparel but cannot canvass
    or influence any other voter while inside the
    boundary of the voting station.

  • Within the voting station boundary, no
    distribution of any posters or pamphlets,
    stickers, cards.
  • Within boundaries of voting station, Party agents
    and all Candidates cannot
  • - wear, carry or display any visible party
    political apparel, or display or distribute any
    poster, pamphlet, etc
  • - Attempt to influence or influence or persuade a
    person to vote or not to vote for a particular
    party or candidate, or not to vote.

Electoral Court Sanctions
  • The Electoral Court established ito the Electoral
    Commission Act and has status of a High Court. It
    may impose any appropriate penalty or sanction,
    including the following

  • A fine not exceeding R200,000
  • The forfeiture of any deposit

    public media, hold public meetings or marches,
    entering a voting district to canvass voters,
