inventor to exclude others from making, using,
offering for sale, or selling the invention
throughout the United States or importing the
invention into the United States for a limited
time in exchange for public disclosure of the
invention when the patent is granted

PROVISIONAL PATENT APPLICATION
A provisional patent application allows filing
without a formal patent claim, oath or
declaration, or any prior art statement. It
offers a lower-cost first patent filing in the
United States and establishes an early effective
filing date in a non-provisional patent
application filed within 12 months of the filing
date of the provisional application. It also
allows the term "Patent Pending" to be
applied. The non-provisional patent application
must contain a specific reference to the
provisional application.
