Philosophy
  • The student conduct process at Tulane University
    is an educational process whereby students are
    provided opportunities to grow and learn from
    their mistakes by understanding each person's
    responsibility and role in a community.
  • Through this educational process, students will
  • Understand how their behavior impacts them.
  • Understand how their behavior impacts other
    members of the community.
  • The Tulane University Student Conduct System, and
    all components therein, shall, in a fair manner,
    hold students responsible to the standards set
    forth.

Process
  • Complaint is filed with the Housing and Residence
    Life office or Student Conduct office
  • HRL Incident Report
  • TUPD Report
  • Information from University constituent
  • (ex. Professor, another student)
  • Notification of Charges The hearing is
    scheduled primary method of notification is
    through the Tulane e-mail system.
  • Administrative Hearing
  • Student Hearing Board
  • Joint Hearing Board
  • Conduct Hearing occurs
  • Decision of responsibility is determined at the
    hearing
  • Educational sanctions are assigned
  • Outcome Notification is sent to the student,
    through the Tulane e-mail system

Process
  • Appeals All charged students have the right to
    appeal a decision of a board or administrative
    hearing.
  • Written intent to appeal turned in within 4
    business days of outcome
  • Written justification for appeal turned in
    within 8 business days of outcome
  • Justification must be structured within the
    parameters of Code of Student Conduct grounds for
    appeal
  • Disproportionate sanctions
  • Arbitrary decision
  • New evidence
  • Procedural errors
  • It is important to note that the student does not
    meet with the appeal board. This board determines
    if an appeal has merit based upon the case file
    records and the students written justification.
  • If an appeal is found to have merit, a brand new
    hearing is schedule.

Process
  • Sanctions must be completed to the standards
    outlined in the outcome notification, submitted
    by the assigned deadlines to the appropriate
    office.
  • If student fails to complete sanctions by the
    assigned deadline
  • Disciplinary Probation , minimum of one semester,
    lasting until the sanctions are completed-which
    may lead to
  • Inability to participate in Priority Housing
    Selection
  • Inability to participate in Greek recruitment
    activities
  • Inability to study abroad

Alcohol Drug Policies
  • Tulane Alcohol Beverage Policy The Basics
  • Not permitted to possess or consume if under 21
    years of age.
  • Alcohol is not permitted in public locations on
    campus.
  • All events including alcohol must be properly
    registered with the University.
  • Residence Hall Specifics
  • Empty containers are prohibited
  • All residents and occupants of a room must be 21
    for alcohol to be present

Conduct Sanctions
Codified Sanctions Tulane University has
identified certain violations of the Code of
Student Conduct, which they have determined to
have mandatory minimum sanctions required when a
student is found to be responsible for violating
the specific policy. Alcohol Policy (all may
include parental notification if student is under
21 years of age) 1st offense Written reprimand,
alcohol educational program 2nd offense 5 hours
of service, Admin. Referral to Substance Abuse
evaluation 3rd offense 20 hours of service,
Admin. Referral to Substance Abuse evaluation,
Residential and/or Disciplinary
Probation Disorderly / Disruptive while Under
the Influence 1st offense 5 hours of service,
Admin. Referral to Substance Abuse
evaluation 2nd offense 10 hours of service,
Admin. Referral to Substance Abuse evaluation,
Residential and/or Disciplinary Probation,
Parental Notification (if student is under
21) 3rd offense Residential Expulsion,
Disciplinary Probation for 2 years, Substance
Abuse treatment program, Parental Notification

Conduct Sanctions
  • Sanctions are assigned given the circumstances of
    the specific case. Circumstances that bear on the
    severity of the sanction may include
  • The present demeanor of the charged student
  • The disciplinary record of the student
  • The nature of the offense
  • The extent of harm resulting from the offense
  • The ultimate goal of the conduct process and the
    assigning of sanctions is to result in growth and
    development of the student. This process occurs
    through various methods of sanctioning,
    including
  • Education
  • Policy reviews, reflection essays, educational
    programming, etc.
  • Intervention / Assistance
  • Administrative Referrals to the ERC, Substance
    Abuse Clinic, Mediation, etc.
  • Deterrence
  • Community Service, Presentations to peers,
    apology letters
  • Punitive Action
  • Fines
  • Residential Probation Not in good standing with
    HRL, may lose privilege of on campus housing
  • Disciplinary Probation Not in good standing
    with Tulane, Deans office notified, recorded on
    transcripts.

  • What situations warrant an administrative
    referral?

FERPAFamily Educational Right to Privacy Act
  • FERPA protects against the disclosure of a
    students educational record without the written
    consent of the student. However, FERPA permits
    disclosure without consent when disclosure is
    determined to be necessary to protect the health
    or safety of the student or others. FERPA also
    gives the University discretion to disclose to
    any parent or legal guardian of a student under
    the age of 21 information about a violation of
    any policy of the University governing the use or
    possession of alcohol or a controlled substance.
  • Garnering Consent can be done in one of three
    ways
  • The student can sign a waiver to release certain
    records in person in the Office of the Vice
    President for Student Affairs
  • The student can demonstrate tax dependency to
    parents by submitting copies of their parents
    most recent tax return.
  • The student can call a parent while seated in an
    administrator's office and sign a waiver on the
    spot.

Parental Notification
  • FERPA permits disclosure without consent when
    disclosure is determined to be necessary to
    protect the health or safety of the student or
    others. FERPA also gives the University
    discretion to disclose to any parent or legal
    guardian of a student under the age of 21
    information about a violation of any policy of
    the University governing the use or possession of
    alcohol or a controlled substance.
  • Alcohol and Drug Incidents
  • If the student is under 21 years of age and found
    responsible for violating alcohol and/or drug
    policies as outlined in the Code of Student
    Conduct
  • Notification in writing, in the form of a letter
    from the Office of Student Conduct to the
    permanent address on file with the University
    Registrar Office
  • Incidents that Endanger the Health and Safety of
    Students
  • Examples include suicide attempt,
    life-threatening illness and serious injury such
    as car accident or student death.
  • Parents will be notified via telephone by an
    appropriate staff member based on the nature of
    the situation.

  • 25 Disciplinary Fine typically charged when a
    student doesnt appear to a hearing scheduled for
    them.
  • 100, 200, 300 Disciplinary Fine typically
    charged for various levels of non-compliance with
    an administrative Referral to Substance Abuse
    Evaluation
  • Community Damage Fines
  • Individual Damage Fines
  • Failure to Attend Hearings
  • Waiver of right to address charges
  • Automatic finding of responsible for all
    charges
  • Minimum of 25 disciplinary fine (can increase
    depending on circumstances)
  • Additional charge (and finding of responsible) of
    Failure to Comply
  • NOTE This does not waive the students right to
    appeal the decision, however, their failure to
    attend the hearing IS considered with the case
    file by the appeal board.
